For the cutout to be useful it would have to be between the engine and the catalytic converter right?
Well in CA that is considered a closed system and any modification to it or one of its parts is considered a "modified emissions device".

I'm pretty sure what you would do then is go to court and fight the ticket, then the entire ticket would be thrown out as if it never happened. So it would just take a day of your time

Adequate Muffler Required

But if the cutout is closed, then the emissions system is still in full working operation, therefore persmissable. Much like how a nitrous system that is unarmed and disconnected, can be legally legally installed in a car. That's how I understood it from the domestic V8 gear heads, but then, they don't really get the same attention from the police as the Japanese import crowd.

Also, see my previous post quoting the vehicle cods that specifically makes cutouts illegal...

BTW, you can order a copy of the annually revised CVCs from the DMV for a nominal fee. True, you can get it off the innanet, but this way, you don't have that burning sensation on your chest when you fall asleep from reading it.

My Uncle works for the smog section of BAR, and it's not illegal to cut off your muffler aslong as it's not louder then the 85db or whatever it is(In most cases with a cutout they are to loud anyways).
If cutouts are illegal, then how did I bring my car to a smog ref with it on, and he didn't even mention it to me...?

the guy had it on a lift, where I could see the cut out standing 30+ feet away... I doubt he overlooked it. I don't think a smog ref would "overlook it" if it was SOO illegal. I didn't know the guy doing it, nor did I talk to him. Why would he just magically make me pass, with something so blatently illegal?

Were you in for a noise violation or a modified emissions ticket inspection?
Perhaps he saw you and was afraid your wannabe Eminem *** had a wannabe G-Unit that would posse up and bring the noise if he messed with you?
Maybe your uncle that works for the smog section of the BAR did something illegal and pulled some strings for you?

No, I just bought the car and had to have it inspected from the DMV. I went to a random smog shop, and my uncle had no idea of the purchase, so there was no string pulling...
I can't blame the guy for being intimidated by me though if that was the case, because I truely am hardcore
Edit: Not to mention. I have MANY america car friends with cut outs, who have ALL gotten their car smogged at different shops, with no string pulling and passed, with flying colors.... Guess they all got over looked too...

Lets go down to the CHP office with your car and ask an officer to come out and look at it to verify that the cut out is legal. If they say it is legal I will give you $100.00 cash, if not you admit you are wrong here on the forums. You don't have to pay me anything if the officer says the cut out is illegal, but if it is I get to file a citizens arrest ticket and have you written up for the violation.
