Warning to everyone that has this skid plate. don't be retarded like me.
2 things: Be sure not to over tighten the plate so it flexes and make contact with the oil pan. The tech at the shop didn't know that. Luckily the pan was more robust and wore out the plate and not the pan itself.
Second add washers to put space between the pan and the plate. I doubled up the washers on the rear to put extra space between the pan and skid plate.

Hope no ones else runs into the problem like I did.
