Will my friend get jail time?

Will my friend get jail time?

Friend was bailed out this morning after being arrested for DUI and doing 86 in 55. He thinks he'll just pay a fine and lose his license for 1yr., but I'm sure it'll be more. His driving history once had 10pts., and was suspended back in mainland. I'm thinking around 3-10 days in jail, fines, community service, loss of license for 2yrs., and some kind of substance abuse class at his cost.

What's Oahu like on this matter?

DUI'S in Hawaii due take into account your driving history, but most importantly your past DUI'S and if your DUI caused significant damages to property or injury to a passenger/third party. If this is his 1st DUI, I highly doubt that he will have to serve any type of jail time. I have been on numerous DUI cases and have only seen a handful get jail time. Hope this helps.

No damages/injury done to anyone/thing. It's his 1st, but his driving record is what I was thinking would do him in. My home state has a zero tolerance policy, and with all the DUI commercials I see in HI I figured it to be the same or similar.

Again it will depend on the presiding judge and if you friend gets a competent lawyer, but jail time is highly unlikely. Your friend will likely take a huge hit in the pocketbook though.

hey hslin, long time no see or hear from!! How you been?? Well back to the topic, getting a dui for the first time wont be so bad based on my two friends who got into a DUI situation!! First offense i think is you gotta pay $1000.00 fine, suspended license, driving school/classes, and if you need to drive to get to work or something, they'll put a time restriction on you to drive.. Hey hslin, please correct me if Im wrong.. Hope he doesnt get into too much trouble

Hey Walter!
Been so busy at work I haven't done anything car related in a long time. I saw the Sti in Japan at the Tokyo Motor Show, which got my blood pumping again! Anyways, your right about the fines, classes, driving restrictions, jacked insurance premiums, etc. Jail time is highly unlikely.
