Ok so ive been wondering if its possible to win this case.
I pay child support and medical for my son and I was wondering if there is anyway I can get a crack at his tax return money? so I can buy him better toys, clothes and food that he wants since im always broke to buy him the good stuff he wants, but I have to keep telling him tell your mom she has the money lol.
I was wondering if I should just ask her if she is down to take turns in having the share of the tax return every other year or should I take it to court?

I am not tax expert but when I tried to file my wife and I's taxes separately neither can claim the tax credit if you share custody. I was only trying to file separate to see if we got more money back but it doesnt work like that.
I dont think she gets any tax money either f she shares custody with you.
get a tax guy or call h&r block, they will usually give some advice over the phone if it makes you a potential customer.

Well when I was growing up, my mom had custody of my sister, brother, and I and because my dad paid child support, he claimed us. As for my daughter, I have full legal and physical custody so I claim her. Her father only provides medical.
IMO, if my daughters father was paying child support, I'd let him claim her. But that's just me.

But I pay both medical $170 and child support $117 every pay check and thats twice a month! I havent claim him for the past 5 years so I think im getting screwed by her. FML!

Jon no cousty papers nothing she just lets me see him whenevers. I watch him 3 days a week.

is your name on the birth certificate? how did you arrange visitation? are giving her money out right or is there legal documents binding you to the amount you provide? is it being garnished from your paycheck?

you may have to lawyer up for this to happen or you'll have to do some mad studying. I think that until you have some sort of custody paper drawn up then you cannot do anything. Since she's the custodial parent she will naturally claim him on her taxes. Child support and medical isn't taxable income so it doesn't count. WE (you and I) get screwed here. This is why during my divorce papers I put a tax exception guideline in that'll give me a break every other year.
wait... do you claim him throughout the year? IF and ONLY IF you do then by right you should claim him at the end of the year. If she takes the exemption while you claim him through the year that's illegal.

start doing you homework. does she work? if so how much money does she make? did you GIVE UP CUSTODY?
I don't want to get your hopes up but talk to someone and see if you have a case. it'll cost money bro. At least you are in your sons life.

damn bro. sorry to hear about this misfortune. what prompted you to think about a tax exemption this year when you haven't claimed him in 5 years?

like what I said in my first post, to buy my son things that I cant afford with the money I dont have. Its just never cross my mind untill now.
I never told her yet about this stuff so I have to surprise her what what im doing since she ***ing me over.

i have been paying child support for 8 years and i was only able to claim my son twice and that was b/c me & the ex were still together. after that she claimed him.
it was never in writing about taking turns so i couldnt do it since she was the primary care giver even tho she had him 1 night more outta the week then I did.. now that were finally done and have come to good terms we agreed to take turns claiming him....
its all in writing now and under court order..... so long story short. you dont need to go to court to do so but you will need it in writing that she will allow you. if you cant get her to do that then you may need to lawyer up. if you need a awesome lawyer lmk.
