Question Can I Do This??

Ok, so I just been informed by a couple of our neighbors that their houses had been broken into..Out of the 6 attepmts total on three houses, twice the neighbors and cops caught the perps..But what I want to know is if they decide to break into our house, can I legally put a hurtin on them seeing that 1. they are trespassing on private property! and 2. 2nd or 3rd degree burglary. Other than my car parts, laptops,ps2+ games, and authentic samurai sword I got for XMAS from my g/f,and my families lives at stake(god forbid) I could care less what they try and take. I might try and check out tomorrow the free legal services that are provided I believe by the state/C&C or Ill just ask my Uncle for some legal tips..

What do you think??

From a Police standpoint, you have every right to protect yourself, your family, and your property. If you catch an intruder in your house, you can defend yourself in a justifiable manner. However, I do NOT recommend that you take the law into your own hands. Two examples for you:

If the intruder attacks you and you feel you need to use whatever force necessary at the time to keep him/her from causing you or your family physical harm, so be it. You are covered within the law.

However, if you scare the intruder, he runs out of your house, you chase him down, and still beat the hell out of him, you might be held liable for your actions.

All I can recommend is to use the least amount of force necessary to subdue the intruder. Any more questions, feel free to ask.

I am not an attorney, and have never played one on TV.....

IIRC:

You can defend yourself or your family if you have any reason to believe your or their safety/well being may be in danger.

You CANNOT beat the crap outta the person just for stealling and trespassing without having to face some sort of charge for battery.

Of course, there are a ton of other issues that come into play.

Some things you may want to consider doing since you already know your area is a target:

Don't make it easy for someone to break in. Don't leave the windows open while you are at work. Don't leave tools, ladders, or anything else lying around unsecured that the thief could use to break in.

Consider putting stronger/more secure locking mechanisms into your doors.

Lock up valuables.

Consider installing an alarm system.

sry but if someone braks into my house then i'm going to subdue him any way i can....hell. i'd subdue the crap outta him. ppl like that have no respect for your proporty so i have none for them. am i the only one that sleeps with a shovel under their bed?

Thanks Yall

Hey thanks for all the info's..I kinda took that the action into consideration about beating the guy up outside my property and the result will be assault and battery!I just remembered seeing an article a long time ago about a burglar suingor trying to sue the family of the house he broked into because he slipped and injured himself but dont know the end result of that case!!!

-Hey hslin, are you the one I sold my JDM FHI STi strut bar too at foodland when you were attending a brunch thingy that Sunday??

..Kinda thought that was you!! Are you in the Kahala beat?? reason why is because a blue and white with a oriental driver threw a shaka at me a couple weeks ago and responded back..Heard about the new shifts that they're making you guys work..SUCKS HUH?? Well see you around bro!!

^^^nah i'm not violent enough to kill someone, you gotta be pretty sick to do that. i just wanna mame and disfigure him...as like a deterrent to other would be burglars. plus i like to hear the bones crack

you also might want to leave lights on around the house making it a less of a target to be broken in to. is the popo steppin up the patrol in the area?

^^^..Yeah, at first there were only like 3 houses including us who left or flood lights around the house on plus our dogs always on the watch and the popo's are noticeably been patrolling in various times! Good thing, if one dog barks, the entire neighborhood of dogs here start barkin..

walt, i got burgularized several years ago while i was living in town. They actually came in while people were living in an attached studio right next door. but anyway, if you keep it reaaly messy and disorganized, they ain't gonna find crap, and just leave. I think my robber just got some coins and a roll of quarters... Frickin meth-heads and crack ****** i tell yeah. Keep on the watch for a lookout on the outside, while someone is on the inside. Also, my guy i heard was on a skateboard, and so was the lookout. Some things to know, G/L man.

P.S.- And i pity the foo' if you catch him. I'd mess him up, then prolly sit on his face and fart on him till popo showed up.

hey thanks chris. I dont want to push my luck so knock on wood.............................
But yeah, Ive been on the look out since then and kept an eye on any suspicious person whom ive never seen in my neighborhood before.. What is weird now that I think about it is before, we never had these types of activities even though that posted those neighborhood board watch signs and our neighborhood is peaceful and friendly till recently.. Oh well, not all neighborhoods are perfect!
