need a little help...

a few months back my warranty was denied for a broken 1st gear and bent prop shaft. I need to know if any of you have had a broken trans similar to this where warranty work was honored and not denied. thanks in advance.

What reason did they give for denial? Mods, or owner abuse?

user abuse (I only have a catback exhaust)...I'm just trying to get some general info on their "biased" opinions. I know that SOA colaborates with the service manager and make a joint decision, but in my case, I was told " the SOA rep will be here in 10 minutes" 30minutes later I had verdict. "warranty denied due to user abuse" I asked repeatedly how could they come to this conclusion. He (service mgr.) said it was an unusual break and they think the only way it can happen is from downshifting to hard into first, or dumping the clutch. where as both cases are not true. I asked them about the gears and a possible defect from the factory, case hardening issue, metal pieces in the trans etc. they said "our transmissions dont break" and later used this same excuse when it took 21 days to get a transmission stating they are on back order because the 5spd trans dont break.

I just have a feeling that there is no rhyme or reason to the decision made by the SOA reps. I think that they saw a young kid (I'm 23 so I dont think I'm that young anymore) and decided that I was f#ckin around and destroyed my trans. it could have been any number of reasons why it broke. and I also am still confused as to the clutch, flywheel and clutch pressure plate...how can none of this stuff be affected by the trans breaking, or if I did dump the clutch or abuse the trans (in their opinion), how come none of this stuff broke before the trans... anyway, sorry for the long post, I'm no mechanic and feel pretty lost in this whole situation because of my lack of mechanics knowledge

I am putting together information for my small claims case that I will start as soon as I get the subie back from paint and squeaking strut fix. so far defect in the paint, broken trans, squeaky strut bushings. I just hope this will all end pretty soon.
