Austin agreed to pay back the money I gave him for the tranny but I need to ask everyone, should I just ask for just that? If he wouldve told me the truth that the tranny was bad I would have not even bothered to buy it from him. Now I'm left with a MPJ tab of $400 and worst my car is in their garage without a working tranny. opinons?? And I think I do have a solid case if I do take it the LAW but i really dont want to that to Austin.

I think this is a good lesson for everyone. If you buy something from someone on the boards take the time to make a receipt. Confirmed that the seller is legit and hes not selling a POS item. I've learned my lesson and I'm sure Austin has. I just wouldve wished I learned it before I met him so I'd be +$400.

Now if someone has a "working tranny" I would love to buy it. I just really cant deal with Subaru dealerships and buy a $4000 tranny.

W3RD, you have the legal backup of the sale w/out a reciept as you have pm's regarding the sale, this is obvious proof that a transaction happened and should hold up well in court.

I'm no lawyer but it looks like you have a good case.

Didn't you say your dad's a lawyer, even though you can't use lawyers in small claims, he should be able to advise you of what to do.
