Who pays the vet bill?

So at the dog park this evening my dogs ear got bit. I didn't see who did it but piecing together the sounds coming from a bull terrier while my back was turned and the fact that the owners were constantly telling the dog "no" when it approached another dog, I'm guessing he made a warning snap towards my dog, and the ear didn't get out of the way in time. Unfortunately though, no one saw exactly what happened and the owners of the other dog are saying "well there was a pack of dogs there, so we don't know who it was." However, thats where their attitude towards their dog interacting with other dogs comes into play.

So who pays the vet bill? The urgent care estimate for Adobe Animal Hospital in Los Altos is $800 - $1,200 for 24 hours of care, the final bill is unknown but he most likely will be there less than 24 hours.

Does the other party pay in full? Do you split it? If you split it, is it 50/50 or 25/75?

I know its part of owning a dog, but I should be able to bring my dog to the park without having to worry about having to go to the vet 5 minutes later.

If you didn't see it and the owners won't fess up, you're kinda SOL and stuck with it.

How bad was the bite? Pictures?

Section of ear hanging off is about 1 1/4" wide and 3/4" tall. Yeah, I know there's no leg to stand on really when only reasoning out the situation.

Are there any leash laws at this particular park? And if so, were both dogs in compliance?
I mean, it is a dog park, and dogs will be dogs...it is up to the owners of the animals to control the dogs while in the designated environment. Leaving you, the owner of a wounded dog, to pick up the vet bill. Maybe watch the dog a little better, and don't let it get away from you.

Very cute dog by the way. You have to realize that some owners just let their dogs run in a dog park, like it is a playground. Unfortunate that the cute little pups are usually the ones getting picked on when mom and dad aren't looking. I hope the pup feels better soon.

My .02 cents
It is a dog park, so dogs are off leash. The rules include not allow dogs into the park that are questionable around other dogs. And being responsible for controlling your animal means the owners of the dog at fault are responsible for the bill.

Given the other dogs protectiveness of the toy he always has and the anxiousness displayed by his owners whenever he is focused on another dog tells me that he isn't great with other dogs. That is why I don't view it as "We don't know who did it, so I'll pay the bill." If my assumptions of their dogs typically attitude is correct, I'd say the fairest split is 25% me, 75% them.

I'd speak to multiple guys at the park, whoever had their dogs there too. Ask if they sensed some hostility from the terrier and if multiple opinions comeback as yes, then i'd tell them that it's 100% their responsibilty, but you'll be nice to pay 25%, if not. Take them to court and say you'll aim for the dog to be euphemized. (or whatever you spell it)

I'm newish in town, but luckily I've been here long enough that people there know who I am and will be honest with me. Had this happened where I used to live, my old boss (who knew about pretty much everyone in the area that ever had a dog) would have been on the streets petitioning for the terrier to be put down.

I am planning on going back tomorrow (when I have the final vet bill) and talking to some people. I just wish more people knew me in the area so they knew I was an honest person that doesn't go around trying to scam people.

The vet bill will be enough evidence, a long with your dog's ear wrapped. Just say you're trying to protect their pets from such vicious acts. Bad dog = bad owner.

If your back was turned while it happened and no one else saw exactly which dog did it, the bill is on you, unfortunately. I'm not sure how you would prove to the owners of the bullterrier that their dog was responsible if you didn't actually see it happen.

Thats why I know I wouldn't have a leg to stand on in small claims court. The dog's displayed aggression and possessiveness of the toy (not sure why they bring his toy to the park, it's obviously asking for trouble) are really the only logical proof there is, although its not irrefutable evidence.

Also, there response wasn't "What the hell are you talking about? Our dog isn't aggressive." It was "Ok, we'll pay."

I would also talk to other dog owners and see if the can back you as to how the other dog reacts with others. I Would try to make them pay it doesn't always work but worth it to try. We just had to put a pup down, he was poisoned at a dog park they said by a mushroom or someone put poison there all in all it costed 1100 to figure out what happened to him and putting him down. We couldn't prove who did it so we were stuck with the bill. Granted the bill wasn't as much of a worry as losing him was. Best of luck to you hope you get them to own up.

Here's why you don't...

A) Name your business after yourself
and B) Publicly list your business address as your house.

That's a mighty nice looking house. (no I will not post the address for you guys).

Which dog park did this happen at?

I have seen similar things at the Los Gatos Creek Dog Park where owners bring in their dogs that they know are aggressive and follow the dog around warning them not to interact with other dogs. So W(hy)TF are they at the dog park?
