They'll search your car no matter what you do... You can disagree and not consent to the search but they will search your car if you like it or not.

The police are looking for probable cause and unless your car is 100% stock, you're parked and not in your car, then they will search your ish.


If it goes to court, it's your word against the officers and guess who always wins in the eyes of the judge? The police.


So in short, you're screwed no matter what. The only thing you can do is be smart like Manny was.

that's a guaranteed recipe for disaster if you respond with that...

they can/will just have your car towed to a lot for further inspection.

do you think they are going to just say, "ohh, okay, well you can go then" hahahah

you give them a hard time, they can and probably will make your life hell.

The nicest cop will not accept that. A cop with ego might just go all out and ticket for anything and everything. If you lock your hood I cant see why he wouldnt tow it just to teach you a lesson. Is it right? ... doesnt matter. If you are told to pop the hood. POP IT.

Why do you think that is? BECAUSE no one stands up to their civil liberties anymore. Hell if I'm going to let a government employee (of which I am one) search my vehicle without a warrant or due cause. If they do I'm going to be a millionaire and retire after the lawsuit.

Exactly, looks like the last few people highly disagree with out views... Your car, is like your house, without warrant, its kinda on them. Same thing with searching locked compartments in a vehicle...

If you have a modified muffler, or anything for that matter the cops can make you pop your hood. If they have suspicion of anything else they can search the rest of your car even if it's not within the scope of the original search. A car is NOT like a house!!! Your house is on YOUR property.

I have a friend whos brother is an officer. he was pulled over for his exhaust. The officer asked him to step out of the car but before stepping out to pop his hood. His brother told him not to and proceeded to ask the officer why he has to step out of the car and pop his hood. The officer puffed up his chest got on his soap box and went on about how he is an officer and has the right and how dare he question him and his authority. After the officer ran out of breath saying everything my friends brother pulled out his badge and said are you sure you know what your talking about? The officer handed my friend back his License, reg and insurance, said have a nice day and walked away. They both said the look on his face was priceless and they wish they would have gotten that recorded.

Correction. Your vehicle is technically private property, you are governed by private property laws until you remove yourself from your vehicle.

If you give them due cause they can search anything they want, but IF they ask to search you can refuse it based on the 4th.

Now if you're out tooling around with a stupid loud exhaust and you look like a road racer that is illegal 'looking' then they have due cause which removes your right to plead the 4th.

Also the castle doctrine says you can protect your private property, your vehicle is an extension of your private property as a private citizen you own it thus making it 'private property'.

no because (other mods in the engine bay) are not visible from eye view without the hood popped. They can ticket you for a modified exhaust but they cant tell if its catted or not without 1) going under the car, which theyre too lazy to, 2) you consent to opening your hood which you can deny if you like.

Only reason this is a valid claim is because they have to ASK you to open you hood. You have the choice to deny that. If its not in sight of the naked eye you're fine, unless they possibly state, it smells like fuel. Goes in line with you opening the window and it wreak of weed, gives them enough suspicion. Going back to search anything that's not in the scope of the original suspicion, THEY CANNOT. Just because your engine is modded doesn't mean they can assume you're a drug dealer and call for a full car search.. At that point call superiors and deal with them with a lawyer. LEO's do not have every right over you.
Oh and after some research this is no CVC for vehicle search, which can be at LEO discretion if I'm correct so you can deny nothing can force you.
