i have a simple solution to this whole issue... don't issue cops tasers.

we'd be better off as a society if half the people they taser and arrest were just out of the genepool instead.

This is my question too, but when I read the transcripts, he didn't have handcuffs on, he was just holding his hands behind his back.

I suspect the officer was a bully, I am pretty certain he wasn't planning on shooting anyone, but I think it made him feel good to hurt people.

If you intention is to hurt people and you mistakenly kill someone, isn't that murder, because you were intending bodily harm?

I know a parent that I believe was sent to prison on murder 2 charges due to a fistfight over a kids ball game. He was steroid buff and beat the other father to death (roid rage). I think the sentence was murder because he was intending to do bodily harm to the other parent, and accidentally killed him.

NOTE:

Murder 2 : A killing caused by dangerous conduct and the offender's obvious lack of concern for human life.

officer didn't mean to kill him, but messed up in a huge way and needs to do prison time
If he was intending to tase a suspect, who is not resisting, and accidentally kills him (no matter how, chokes, medical condition, pistol etc.) isn't that murder 2?

It would only be manslaughter if he was negligent, i.e. driving too fast, but he was working on giving a non resisting suspect pain (I'm pissed and I'm gonna hurt this guy a little) and killed him in error.
