What do you guys think of the Oakland-BART cop shooting?
You all remember when BART officer Messerly shot and killed an unarmed civilian that was on the ground face down AND tied up. The officer claims that he thought his gun was his taser, which resulted in a fatal single gunshot to the victim's back.
Now that the trial is over and they said that he wont be getting first degree murder, what do you guys think about the whole thing? What are your predictions for his sentence? What do you think he deserves? Do you think he should have been charged with 1st degree murder?
One thing I want to know is why would the officer have used his taser on the victim when he was already face down AND handcuffed? In the video it doesn't show him doing anything to really resist... I dunno, seems fishy to me.

those cellphone videos do not show what happened before he was on the ground. there will be riots in Oakland with anything less than murder. hell, there will be riots in Oakland even if he gets the death penalty.
was this murder? no. manslaughter? yes. there is no way this is first degree murder unless they knew each other before and had conflicts with each other before that day.

I think that community needs to focus energy on rebirth, rebuilding and prosperity and not lack, victimization, riots and looting. That's my $.02 on Oakland after living there for 10 years.
It's unfortunate that guy was killed, no matter what, that life can't be replaced... the case will be forgotten about in 2 years.
