Watch Out! First of the Month...quota time.
Happy first of the month to everyone,
Just got pulled over this morning on EB 80 by CHP on bike near ranch 99.
Reason = tinted side window VC 26708 a
And non correctable...
Situation:
I was driving about 70-75mph behind another car when i saw Eric Estrada pull onto the freeway next to me. Shoulda rolled down my window
, but i have never had a problem with my side tint in the 5 years i've owned my Subie. So i opted not to.
Mr. Estrada sat in the lane next to me (in my blind spot... as though i didnt know he was there "stealthy") for about 3 exits then got behind me, flipped on his red n' blues and pulled me over.
As i pulled over (and i suggest everyone does the following)
1. rolled down ALL my windows
2. turned off my car
3. put my hands on the wheel (or one one the wheel one out the window)
4. and do nothing until "GOD" told me to.
He then comes up to my window and tells me y he pulled me over. Then he goes back to his bike, gets this little device, tells me to roll up my window a bit, and uses his tool to measure the amount of light absorbed by my tint. (Oh, my tint is not that dark, just enough to keep me from browning up while driving).
After all that, he goes to the front of my car to take a gander
(thats when im thinking please dont look at the FMIC). lucky he missed that... or perhaps he was looking for a front plate (make sure you have those on. just one more reason) and saw a "radiator".
Writes me up a ticket (non correctable by the way. What a B==D ) makes me sign it and doesn't even instruct me on "how to merge back on safely". Even worse, he takes off before i can even get my seatbelt on. WTF?!?!
So Just a "be careful" warning! Be Careful!

not to mention today is also a holiday... im sure more than normal were out all this weekend.
still sucks tho... the only ticket ive gotten in my wrx in over a year in a half is the front tint as well.. my windows were half down when he flipped his lights on and i rolled them all the way down when he pulled me over too

actually its END of the month that is "quota" time because they are rushing to get more tickets because they didn't issue enough during the month.
Quotas are also supposedly a myth. The point of law enforcement (as it is written, not as it is practiced) is to penalize those breaking the law. Having a quota would make it so that police have to find a x infractions, but what if there are only x-10 infractions that occur? That would force them to falsely penalize 10 people.

Quotas are a myth, and definitely unethical and illegal. But most of the revenues come from traffic (example: go park your car in Berkeley for a day and tell me there is no quota). It may be a phantom quota, unwritten rule, etc. However, there are plenty of people out there breaking the law without even knowing it. So the police don't have to cite "innocent" people, just those who are innocently unaware.
No doubt, i know that tint is illegal on the side and i probably deserved that ticket, but c'mon? really? tint?
How about all those at gunpoint takeover robbery's going on around the bay? Tint?
i get it now!... when funding = low ---> tint ticket = increased $$$$$$ = funding = fighting crime = 10 min response times to takeover robbery's.
It all makes sense now

I thought tint is just a fix it ticket?
I have got pulled over for tint, fixed it and went on my merry way(still got the tint put back on though, just not as dark)
does it change from chp to city police?

If it will be cheaper, fight the ticket in court. Ask the judge to make it correctable. Add that you understand the nature of the citation & the letter of the law, just perhaps the spirit of the law wasn't communicated by the citing officer.

how can they put it as non-correctable? it's just tint and should only be a fix-it ticket, doesn't make sense...do they do that just to be a-holes and make you pay more?

Quotas are a myth in the same way as sales goals. Many sales jobs "encourage" you to sell x a month. Of course its not documented anywhere, but if you miss that number a few months in a row you'll be looking for a new job.

Hey bro, just some friendly advice from the "inside."
There's no such thing as a "quota," and if there was it would be a grouping of averages for all officers on a specific shift. Everyone kinda needs to stay at the same "activity" level or some people look like they don't do **** all day. If your only job is to write traffic citations (and that's EVERY cop on a motorcycle) then you should probably write a few of them.
It's not the officer that decides if the citation is correctable or not. If you are cited for an equipment violation it is correctable, unless the county court you live under says it isn't. The correctable yes/no boxes are kinda just a guideline for you.
CVC 26708a needs to have another sub section denoted. As that violation stands it is invalid. There is no plain CVC 26708(a). If that is the violation on your citation then you need to go to court and request either a correction of your citation or a dismissal. If your tint was too dark (88% light needs to pass) then your correct citation should be CVC 26708(d)(1). If the court does not say that the violation is a correctable violation then you pay the fine. No big deal though, because it's not a moving violation (meaning you don't get a point and pay more insurance).
Most courts now are moving to where you can't even contest a non moving violation...which in a situation like this is bull****...and here's why: Courts issue a schedule of fines for specific violations. You were cited for 26708(a). There is a fine associated with that section specifically. You should not have gotten that section. What if the fine you were supposed to get was $50, but the one you actually got was $275? You basically just get screwed. It can get even lamer. Sometimes the court says that a violation (like modified exhaust for example) is not correctible. If you get a ticket for that (and you were even stock) there's nothing you can do but pay a large fine which may even get larger with each additional violation lol.

That's why I notice officers doing patrols at specific/repeatable times & locations not all day & night. I can tell you from direct experience that CHP really only spends 1-2 hours per each half of a shift patrolling in order to write citations. There may not be a "quota" but there are "performance averages".
