ticket for accident?

ticket for accident?

so i got a ticket from the chp in the mail from my at fault accident 2 weeks ago.
it is a VC22350, unsafe speed for traffic conditions where the ticket says i was going 65 and the safe speed being 0. now i have to show up for court. is this normal? do they ticket people for accidents? is there any point to fighting this ticket? it also came with a letter saying a complaint to be filed, whatever that means...

Obviously, I'd ask the court how the safe speed can be 0. It's a fair question, and it might help get the fine reduced.

i think u can get it waved off completely, depending on the judge of course. Usually, when there's a mistake on the ticket, even if the speedlimit is higher than it's suppose to be, the judge waves the ticket. I have gotten away with one like this before. Definitely go in and fight it.

basically, when two people get in an accident, the law sees it as at least one party is at fault. that minimum one party "obviously" had to break the law to cause the accident, since traffic laws are flawless in their eyes. =\

Reading & driving = 0mph.
Cell phone & driving = 0 mph.
Eating & driving = 0mph.

i was just driving, and my mind was travelling. didnt realize traffic was dead stop in front of me. so i'm clearly at fault

+ now that i think more about it, my brake pads were worn out as well. was trying to drive just 5000 miles more to get it replaced during the standard maintanence schedule.

easy, traffic was stopped. If he was stopped, he wouldn't have hit the car in front of him.

You will get a point(s) on your DMV record and your insurance will go up. But I would still go to court and ask/make sure that you don't get tagged twice. Once for the accident and another for this ticket. They should be one and the same.

well, you get one point for the ticket, and insurance hits you twice, once for the accident (insurance point) and once for the ticket (dmv point).

Think of it this way, if you ran a red light and hit someone, would you understand a ticket, and an accident point? It's the same thing here, you failed to stop (0mph) and hit rear ended someone. Although you might get away with it by chance with the way they wrote the ticket. good luck.

Ummm the safe speed was zero...traffic was stopped and there is very little possibility of fighting that. It is entirely the cops right to ticket you for the accident. Now, the vast majority of accidents I come across at work don't have either party getting a ticket but in this case the cop must have felt you really screwed up...
