State Ref question again*semi rant*

Wow so some of you guys know I got state ref'd not to long ago.. and I went back to stock. So I passed all the test at the smog station/state ref and they gave me a certificate showing that I pass.. So I arrive at the court place and the clerk says that Sorry we dont take care of this here, sorry I cant help you.. IM like wtf? I just called yestarday and I confirmed it. He just keeps giving me attitude, but eventually he did find me in the computer and sent me to the court room.... I was the first person called and the judge says $380.00... wtff!!! I showed him the state ref papers and certificate and he still says nooo $380.00... So now I have to set another trial to fight it.

My questionfor all you guys who had been state ref'd before, is After paying $35 for my state ref and certificate...and passing.. do I still need to pay the $380.00 fine? Is that right? I could of just left all the parts on the car and paid the fee to begin with if I was going o pay.

hahah i'm surprised you just didn't pm me. but in my situation when I went to court (san mateo humbolt) I showed the judge all the state ref paper work and she ended up charging me $10 fee I think it might if of been some sort of processing fee. But that was it. Basically if you passed the state ref you should not be charged $380. what does ur ticket say u got it for? Any other stuff other then parts? Speeding, carpool or any moving violations? Your right with wanting to fight it because u passing the ref is "proof" of u not being guilty.

my state ref fee was waved and all I did was send in a copy to the dude sitting behind the window at the court and I was free to go. This was about 2 years ago, and was a ticket for exhaust noise. Not sure if they changed things or if emissions testing cost more but I was told by SEMA (checked their website) and the state ref at the time that if you pass, your state ref fee is waved for the first time. But like I said, not sure if this applies to emissions related tickets. Maybe you should contact somebody from SEMA (or research their website) and explain your situation because I'm sure plenty of others have gone through the same thing.

hahaha I did PM you hah. yeah the judge was a dickwad, he didnt even try to let me talk.. my next court date is next month.

Errm, but he was guilty. His car was illegally modified and he was required to fix it. Same thing with speeding, if I was radar gunned at 80mph and then drop back below 65, that doesn't mean I wasn't speeding.

IIRC, fix-its are a way of cutting people a deal for minor infractions - i.e. put it all back to stock and don't do it again. Also, they are used for items that you might not know about - blown light bulbs etc.

For example, missing a front license plate will usually get you a fix-it, but in SF, they are now typically giving a full fine because they want the plate for the traffic cameras.

If he got a fine, then its probably going to be difficult to fight. OTOH, the judge may drop it to the fee


Good luck anyway - $400 seems really steep!

Hmm when I got state refd all I did was show up to court n the judge asked do I have paper work to show that my car will pass smog and I said yes here it is. He then says ok we are goin to charge u a 10 dollars for processing fee and everyhing else will be dropped includin my provision drivers lisence violation

did the ticket have non-fixable checked on it. if so then it doesn't matter if you fix it or not, you still have to pay the bigger fine

Actually he is not guilty, he went to State Ref and the Ref confirmed that his car is legally modified/passes smog.

first of all it wasn't a fix it ticket. If it was a fix-it ticket he would of just needed to change what was needed and get it signed off. He was sent to the ref. It's different. Like a lot of other people were saying with the same experience. Basically a cop can point out this and that but it doesn't mean it's illegal. When I went to the state ref I asked my ref guy that the cop said my turbo timer is illegal because the cop thought it was a "racing computer" the ref guy laughed at that and explained that most of the time cops will just point at random things on ur car and say it's illegal because they don't understand what it is and would rather be safe then sorry. So he isn't automatically guilty of having illegal (smog) parts just because he was sent to the state ref. It's just the cop assuming that he does because his car may "look" modified

Yup, fair enough - so the cop is indicating that the car should be checked over.
