whats up guys
this is my first time posting on here but i had a question
i just got a speeding ticket down by stoneridge area, and i live in fremont...i was going bout 105..this is my first ticket ever and i have no idea what to do and im kinda worried..im only 18 if that means anything and the ticket says to appear in court within 30 days so do i go anytime in 30 days or after 30 days
any help would be great

damn that sucks. You should recieve something in the mail telling you what to do unless they gave you a date on the ticket. Since this is a serious offense (100+) they make you appear in court, i think? Was this on the freeway or whats the situation, could you maybe explain?

well basically i was going north on 680 and i was going bout 110 and i started to slow down and then i see these red lights behind me far far back and then after about 30 seconds he was behind me and pulls me over...he told me that i was weaving in and out of traffic even though i wasnt cause hardly no one was on the freeway cause it was around 1230am

Did he write you up for over 100mph? If he did, then it's a 2 point ticket, which of course sucks, but it's not the end of the world. Check this.
I was in milpitas, and decided that it would be a good idea to do a fat *** drift around a corner, and speed off. Well, a police officer saw me, and didn't find it too amusing. So, I got a ticket for "exhibition of speed". Which, is 2 points, and a class A misdemeanor.
I knew I couldn't fight the ticket, because the officer would win... and I didn't want to suck this ticket up, so I decided to ask the judge for a reduction... the judge told me he didn't have the power to reduce it, but rather the DA only had the power to do that. So the judge setup a court date for me a week later, I met with the DA right before my name was called in front of the judge. I told the DA it was all a big mistake, and I was involved with a lot of emotional trouble, as I had just caught my gf cheating on me (Something like that). I asked if if could be reduced to a speeding ticket. He agreed. So, my ticket went from over $500, and a a misdemeaner, (which requires community service), to a $105 ticket. I couldn't go to traffic school though
If he didn't write you up for over 100, go to traffic school and get that ish off your record man.

Haha I got speeding ticket in that area once. Silly me, but I was written down as 95. I think over 100 is a misdemeanor? Well anyways, your gonna get something in the mail. It'll show how much do you owe (I owed 271) and your options like 1. You can fight it in court where you will mail something back regarding your court date 2. Pay the fine and get points on your record 3. Pay the fine, goto traffic school and get no points (Can only be done once every 18 months). Those were my choices. I ended up paying the fine, which when they received it, they sent something back regarding traffic school and the certified schools that you can goto (Alameda County doesn't allow online schools, weaksauce huh?). I attended a school (boring as hell!), they gave me a form that shows I attended the school then I just mailed that thing back.
You can fight the ticket, but I would try to lessen the penalties like say you weren't really going 105 but 95 instead blah blah blah. You may even get lucky where the officer who pulled you over doesn't show up to the court so no penalties for you. One strategy is to push the court date as far as possible (the officer may forget) or get a date on a peak vacation time so the officer may actually be out of town or whatever. Anyways, good luck! Everyone gets pulled over at least once in their lifetime, you should turn out just OK. If I were you, I'd try to try to keep your record as clean as possible so the insurance companies won't nail you in the wallet. And oh, I think the penalties could be worse if the officer shows up to court and you lose the case, thus I think you lose the ability to goto traffic school? is it possible to still go to traffic school? cause i heard something bout not being able to if you do over 20 mph over the speed limit

he actually wrote you for over 100..... that sux man, the best would probably to try to get it reduced to a regular speeding ticket and take a point up the ****...... otherwise, you're in for 2 points as is right now..... and being 18 w/ a wrx and 2 points..... i'd be more worried about my insurance rates

Look at your citation to see what vehicle code(s) he wrote you up for. You can then check the DMV website to see if it was an infraction or misdemeanor. Might not be able to do traffic school if its a misdemeanor.
I got a ticket very recently and paid $291 plus a $30 administrative fee to attend traffic school. Still have to pay a fee for whatever traffic school I attend. My vehicle code number was 22350 (Basic Speed Law) and 116028(a) (No insurance info.) which was waived because I provided a copy of my insurance card when I mailed in my payment. CHP wrote me down for 90+. Watch out for the CHP helicopter in the SAC area.
Now waiting to attend traffic school (which would be my 3rd one). I guess I'll never learn.

Dude,
Get a lawyer ! I have beaten three speeding tickets that way. The lawyer usually cost about $100-150, or the amount of the fine. If he beats it he keeps the money, if he doesn't the money pays the fine. He will make the officer prove that what he used to determine you were speeding was calibrated correctly. They MUST provide proof that the radar gun or their speedometer (if he paced you) has been calibrated, if they can produce that then the lawyer will make them produce proof that the calibration equiptment has been calibrated. If they can not produce proof then it will be dropped and your home free.
Just look in your local phone book for traffic lawyers.
A lawyer is the way to go !

Get a lawyer? And just what does that teach our young scofflaw? That you might be able to twist the legal system so that you don't have to take any responsibility for your actions?

well im not exactly sure how he got me....the only thing i recall his his lights coming up hella fast behind me....im not sure if it was from behind me or from the side....and i dont know if it was by radar or by following me...
he wrote me down for an infraction so does this mean i can still take traffic school or what..cause the only thing im worried about is the 2 points on my insurance cause i cant afford that...and whether or not im gonna get my license suspended

Here's the relevant part of 22348.
(a) Notwithstanding subdivision (b) of Section 22351, no
person shall drive a vehicle upon a highway with a speed limit
established pursuant to Section 22349 or 22356 at a speed greater than that speed limit.
(b) Any person who drives a vehicle upon a highway at a speed
greater than 100 miles per hour is guilty of an infraction
punishable, as follows:
(1) Upon a first conviction of a violation of this subdivision, by
a fine of not to exceed five hundred dollars ($500). The court may
also suspend the privilege of the person to operate a motor vehicle for a period not to exceed 30 days pursuant to Section 13200.5.
What you want is to get tagged under 22348(a) rather than (b). Go to http://helpigotaticket.com and check out the stuff on trial by declaration and radar defense. Make sure you don't give up-- just last week I won in traffic court on a ticket I got back in October, and if all this stuff is too confusing look into getting a lawyer.
Finally, and I'm not trying to be an a**hole, slow down. I have a Rex and I know the temptation to stomp on it when no one is around, but you can very easily kill yourself or someone else at those speeds on a public road.
