curious if this situation escalated:

If the guy did break into the house and you pull a gun on him, then what?

if he threatens you with a knife, is shooting him in the leg self defense? Is shooting him in the head as he enters the house self defense? I have some idea but thought i'd throw it out there.

curious how situations like this can unfold, and what the homeowner is allowed to do per the law

its all about how you articulate your story. Breaking and entering, you draw weapon, he appears to be drawing weapon...you shoot...SELF DEFENSE because you believed he was intending to cause bodily harm to further commit the robbery.

It's all about what the DA deems "acceptable force". If the guy pulled a knife and Bruce pulled a gun and fired, that's self defense. If Bruce emptied the clip on the guy, or shot him in the back, that's different.

Yea, My lil cousins are some bad asses. I caught them dialing it and when i took the phone it was still ringing until i heard the "hello 911,...". I hanged up, they called back but i told them what had happened. theyll either call you back or theyll send someone over if noone picks up.

Yup, If you shoot someone in the back, youre gonna lose. If some breaks into your house and you shoot them in the back, the DA will see that as the suspect was trying to get away. If he has only a knife, you can only shoot him once. ahaha. Anything more, will be seen as excessive and you will get in trouble for that.

If Someone breaks into my house, I'll shoot him once in the chest just for coming into my house and then call for cops and ambulance.

daniel...recommendations? Was thinking like a 10mm or a .45. something accurate.

My dog is pretty scary and is pretty damn aware of stuff going on around the house but you never know.

If it's purely for home defense don't buy a pistol. Buy a Remington 870 (there are many flavors but all will do) 12 guage. A shotgun is cheaper, more reliable, easier to aim (a relative term with a shotty) and pehaps most importantly for those of us living in close quarters, it has a much lower tendancy to over penetrate and go into rooms/homes behind the target. If you're hooked on the idea of a pistol, or you want it for home defense AND recreational target practice I would suggest either a .45 or a .40, NOT a 10mm. 10mm are known for crazy penetration which like I said, is bad news for us in townhouses/apartments. Plus, the 10mm round is overly expensive which means you are less likely to buy large amounts of it and practice, making you potentially dangerous. Practice makes perfect, so buy a pistol you can afford to practice with.

Read up on the safety slug. Nice penetration with a good dispersal. Not something that will over-penetrate, AND they make it in 10mm sizes as well.

I was also wondering, what if you shoot/kill someone while they are breaking into your house? IF they misinterpret the situation and say you used excessive force, could you possibly serve prison time for injuring the thief? killing him?
