I thought about going thru insurance but the damage is just a minor scratch but the police officer was their with us when he agreed to pay out of pocket so I'm sure with the police involved their shouldnt be a problem.

Call insurance. Get them involved. This way, it shows up on HIS insurance record. 
Since everything will get subrogated, your insurance won't pay a dime, so your record won't show anything, and your rates won't get affected. However, HIS will.
