Well... For sure as speed increases there is far more air underneath. There is lift there, so I can only imagine that they want to deflect the air downward into something or stabilize the airflow directly backwards into something. Could also be directing air to outside of the car or the side pod intake.

Yes. If it passes the static load test then it doesn't matter what air does to it.

 

The tip looks like a vortex generator... Guess its creating one only when at high speed; looks like it'd drive a stream over the wing or under it? Coanda-redux?

Do the static load rules only require a downward force be applied? It might pass that if it only moves up under aero effect.
