NOT Guilty of 22350; Speeding
Yep,
my december speeding ticket was ALSO not guilty.
This one the officer turned in his case, and i won.
$98 coming my way... 2 tix, won them both....
It's worth it folks, Trial By Written Declaration!

Yeah man, I just can't believe that the judge ruled in my favor. I thought if the cops turned in their case, i'd be slammed. But i guess not!

ooooohh, give us the details. did you argue facts or law? i cannot believe that cops write people up under 22350. that statute is like swiss cheese. if you cite the court of appeal cases that basically say radar evidence is not sufficient for conviction under 22350 you should win every time.
if it's not totally obvious i'll disclose that i'm a geek law student.

can you send to me a copy too. I already have a court day scheduled.. i need as many info as possible to see how i can fight it.
for my case.. the cop gave me a speeding ticket saying i was going 60 on a 45. and i swear i didn't even go over 45. (on that road, my car couldn't go faster than 40 or my tire will be sctraching the front fender like a b*tch since my wheel gap is very very small.).
to: Soya. since you are a "law" student. i need some advise
can i use a video recorder and re-record the same road i drove on and show the judge and say.. "look.. even if my car is goign 45 on the speed limit.. i will be sctraching like hell.. .. and how in the world can i go over 45 into 60 zone., for car enthurist like me.. i dont want to hurt my car." .. plus that cop who gave me a ticket didn't show me the speed gun anyways... is that good enough for prove that i can't go over 45 on that road?

what i would do is ask for a trial by declaration. this allows you to write up all your evidence and send it in without having to go to court. you might want to get notarized statements from people saying that on that road your car can't go over 45 without speeding (make sure that's true-- you don't want to ask someone to commit perjury). the more detailed your case the less inclined the cop is going to be write up a response, which means you get off. i would also include the fact that he didn't show you the radar if you asked and he refused.
the danger with trial by declaration though is that you give up your right to traffic school. if you've gone in the last 18 months, then you can't go anyway, but otherwise you should balance the strength of you case against the certainty and expense of traffic school.

in a month or so i go to fight my only ticket i have ever gotten and i got the ticket on my birthday. I am almost positive it will be dismissed. I got a ticket for a unsafe lane change. I think i explained what happened in another post. but yea its the stupidest thing i've ever heard, i switched lanes then turned into a parking lot right after switchign lanes and the car that was in the lane i switched into was pretty far back. they didn't have to brake or avoid me in any way.
