sorry about that gagan i got my handles mixed up.
btw, great work on those declarations. you had a good mix of fact and law and admitting you were above the posted limit gets you credibility with the judge. just more proof that cops don't understand how hard it is actually convict someone under 22350.

The school zone one was total BS - the cop was just being a jerk. If you had just driven by him, I doubt he'd have told the other guy to stay put, jumped in his car, and crossed the median to chase you down

It's the street above teh parking lot. He literally walked, 12 feet across the street. He just walked... right across.

Yeah I just meant if you hadn't stopped and made it easy for him to walk across, he wouldn't/couldn't have practically chased you down

I just recently (bout 3 weeks ago) got a speeding ticket for 38mph in a 25 zone with a radar gun. I would love to know any information other people have used to get out of these kinds of tickets in the past.. If you don't want to post it online, can you email me (diranged@wiredgeek.net). I cannot go to traffic school this time, so I really need to get out of it.

For tickets involving radar the first thing you will want to do is retrieve a copy of the most recent speed survey for that block (yes the block matters....ie 3300 block of Smith St.).
You can get speed surveys from the city engineering department. They are public record and they have to give you one. If it is expired and the cop used radar he is incompetent to testify and all speed evidence is inadmissable. Depending on how it was completed, and where, the expiration will be five or seven years after the date it was conducted.
Look in the vehicle code under speed traps. This will explain all the information and time limits needed in order for you to demnstrate the survey is "no good"...I have beaten four tickets with this....

Can you explain what a Speed Survey is?
From what Gagan sent me, it looks like I can plead not guilty because I was not driving 38mph, but closer to 30mph -- and it was a clear, dry day with no other drivers on the road. I'd still like to have backup defense that the radar is in-admissable somehow.

Okay, regarding radar as admissable evidence:
1) the officer must show proof that the radar gun was calibrated with the tuning forks provided with the radar gun (must match serial numbers with the radar gun) within a reasonable time ( I think it says a month, but it's been a while since I looked) BEFORE the ticket was issued or it is inadmissable.
2) the road the radar gun was used on must have a valid (7 years) traffic and engineering survey on file, or it is inadmissable. A traffic and engineering survey shows a) traffic density on the road and b) determined safe speed. You know those funny looking hoses that they stretch along the road sometimes, leading to a sealed metal box on the side of the road? That's a traffic and engineering survey in action.

Motorist: "Fine. May I see your tuning fork and calibration record?"(Many radars are calibrated with a tuning fork.)
Officer: "Here they are." (Note: officer not legally required to show you the radar reading itself, but feel free to ask.)
OR
Motorist: "When was the required TRAFFIC AND ENGINEERING SURVEY last conducted on this road? Was it conducted within the last seven years? If so, what did it determine the SAFE SPEED on this road to be?
Officer: "I don't know any of that?"
Motorist: " Then can I assume this is a SPEED TRAP by definition of VC 40802 and that your "evidence" is illegal by VC40803?"
