New DMV Laws

A few fun ones:


Traffic Violator School Licensing

Amend: Vehicle Code §§11208, 11219.5 (AB 758 Chapter 396)

* Requires DMV to submit a report to the Legislature, by July 1, 2008, containing a plan to consolidate all forms of traffic violation instruction programs under DMV’s licensing authority.
* Increases the amount a traffic violator school may charge for a duplicate completion certificate and addresses a fee issue associated with class cancellations.

Smoking in Vehicles With Minor Passengers

Add: Health and Safety Code Article 2.5 to chapter 4 of Part 15 of Division 104. Amend: Vehicle Code §12814.6 (SB 7 Chapter 425)

Makes it an infraction punishable by a fine not exceeding one hundred dollars ($100) for a person to smoke a pipe, cigar, or cigarette in a motor vehicle any time a minor is present in the vehicle.
Speed Contests and Reckless Driving

Amend: Vehicle Code §§11110, 11215, 12810, 13201, 13351, 13352, 14601, 21051, 23103, 23104, 40800, 40804, 41610, 42008.5, 42009, and 42010 (AB 430 Chapter 682)

Includes reckless driving on a highway, reckless driving in an off-street parking facility, or exhibition of speed on a highway within the scope of various other existing statutes.

I can tell you right now how to save tax payer dollars and time... fire our FULL time law makers. Make them part time like most of the other states.

maybe we'd have less stupid laws and less worthless law suits.

Wasn't the no talking on a cell phone law suppose to go in affect this month???

Edit: Nvm, I guess it was bumped back to July 08.

California used to have part time Legislators...back when the PRK was 90% less socialist and wonderful place to live.

that was smart to bump a law that would help reduce traffic and accidents due to people driving 40mph on the freeway and changing lanes without looking because they are trying talk on the phone rather then paying attention to the road and other drivers

I ALMOST GOT INTO AN ACCIDENT LAST NIGHT ON 280 BECAUSE OF THIS. SOME ASIAN LADY IN COROLLA GOING 50 MPH ON THE PHONE SWIRVING INTO MY LANE. GRRR

I think the smoking one is good. We all know that it is no good for kids to inhale that crap.

Yes, but were does it stop?
I'd venture a guess that fast food, poor diet, etc, kills more kids than smoking, yet no concern or gov't action.

Plus, parents that smoke are just helping thin the future herd.

You also have to look at it from the other side. The kids can atleast choose to ingest fast food junk. While, smoking on the other hand, is unavoidable if they're in the car.

The question is, where does the protection of innocent parties infringe on our personal space. I agree with the 'smoking in car with minors present' law, but it does open the door for even more laws and restrictions of our personal space.

I already feel that seatbelt laws do so. If I want to die in an accident, then it is the business of nobody else. As long as I am not harming anyone else....of course, suicide and euthanasia laws are the extreme of this, but I still feel anything that affects me and only me is the business of nobody but myself.

Unfortunately, our government has taken a stance of "if we cannot fix the problem (without putting forth effort), then we will make new laws that allow us to profit from the problem instead."

As for the cell phone law, I believe it will not have the effect people think it will. The fines are stupid small, and it does not address the real issue....it still allows you to talk on your phone while driving!! I tested out my bluetooth headset today, and while I am able to focus on the road and my driving more (and with greater comfort), it still takes my attention away from driving. Driving with one hand is not the only issue, and it is not the most severe. It is the TALKING that is the problem. There is a reason my employer, who happens to be the second largest employer in the US, does not allow use of any type of communication equipment while driving.

Technically speaking, you CAN be ticketed for not driving with both hands on the wheel....shifting excepted of course.

So, unless reckless driving tickets are handed out, there will be little tangible effect. It is the same as smog laws..."oh, I can pay a fine and continue doing whatever I want?"

The bottom line is education. Our education system sucks (which I believe is intentional), our country promotes moral depravity and selfishness (also intentional), and our country is getting dumber by the minute. What better way to keep the public unaware that they are being screwed, than to keep them dumb, selfish, and stressed out?

i never really knew it wasnt a written law though, i just figured a cop could still hassle you so i was always cautious

Maybe I'm one of the few, but I think smoking, like drinking an alcoholic beverage should be illegal in public. I HATE smelling cig smoke from cars in front of me, or even worse yet, from people around me at a "public" function.

So I agree with this new law, and I hope this is only the beginning. Matter of fact, I think I might have read somewhere that California might make smoking in cars illegal... could be wrong though.

yeah smoking seems pretty pointless to me.

i mean its not like they were born smokers, so they shouldnt complain about the laws
