Need your help
So by now I'm sure everyone knows that I had an accident on 8/5/03.
Well yesterday I FINALLY got the police report. The police report claims that I am the at fault driver, however I obviously disagree. I feel that the police report is sloppy and that the officer was biased and had made his decision as to fault as soon as he arrived on scene; Basically I feel like I'm a victim of my young age.
If anyone has any experience with contesting police reports, or if you know whether it can even be done I'd appreciate it. Below are the points on what I'm referring to.
1. When the officer arrived on the scene and was prepared to take statements, he took mine first. His first question, and I quote, was:
2. Even after telling my side of the story, his only questions for any clarification were:
3. The police report includes hear-say. It's my fear that if I were to try and contest this, the report would instantly bias the reader due to the following quote:
The officer never asked me about this statement, and I most certainly did not say that at any time following the accident.
4. Throughout the report the officer refers to me as driver 2, vehicle 2. At the end of the report, however, he then refers to me as driver 1.
Based on the above, do you think I have a case on which to proceed? I pride myself on being an attentive driver and had the trucker made a safe lane change, I would NOT have hit him. I was not speeding, however the officer states that I was traveling too fast for prevailing conditions, which IMO is bs.
What do you think? Thanks.

So, tell me why you hit that semi.
So, were you on your cellphone?
No? Ok, then were you tuning your radio? It's ok if you were, you just need to tell me where your attention was
(said by other driver to Officer): He got out of his car and told me he was sorry . He said he was going too fast to stop
4. Throughout the report the officer refers to me as driver 2, vehicle 2. At the end of the report, however, he then refers to me as driver 1.

Damn Matt im sorry
This won't be the end of it though...
I'm not sure what to do in this situation but I'll BUMP it anyway.
Very Biased view in my opinion from the officer, and the whole car1 and car2 situation is grounds for getting it thrown out.
Damn i hate cops...

I should also add that in reading the police report, my insurance adjuster agrees with my feelings about bias (although I have yet to point out the above discrepancies). She also is going to try and classify the accident as not at fault for me (at least in the eyes of the insurance company), which sould prevent my rates from increasing, but I still don't get my deductible back if the other insurance company doesn't accept some liability.
Once I get some things in order, hopefully with help from here and maybe even a lawyer, I'm going to talk it over further with her.

hearing this, just reinforces my (not so nice) opinion toward about 90% of the police officers out there. Granted there are the few that are actually really good about these types of things...but those are few and far between IMO.
(no offense to any po-po's that post here, I know you are NOT ALL bad.)
Good luck man, thats a really crappy situation.....I am sorry to hear about it.
