Need your guys opinion on this one

22348. (a) Notwithstanding subdivision (b) of Section 22351, ( )1 a person shall not drive a vehicle upon a highway with a speed limit established pursuant to Section 22349 or 22356 at a speed greater than that speed limit.

(b) ( )2 A person who drives a vehicle upon a highway at a speed greater than 100 miles per hour is guilty of an infraction punishable, as follows:

(1) Upon a first conviction of a violation of this subdivision, by a fine of not to exceed five hundred dollars ($500). The court may also suspend the privilege of the person to operate a motor vehicle for a period not to exceed 30 days pursuant to Section 13200.5.


My cousin has a ticket for 22348(b)... Can an Infraction be a 2 point ticket?

I was under the impression that if put down under this CVC that it's a misdemeanor, and apparently it's not.

I'm going to help him try to get it reduced to a 1 point 22349- speeding over max limit. We'll see.

I got caught for 110, went to court, but the cop didnt show up. It would have been a 2 point infraction, $450 fine, and suspension of my license for a month.

From now on, I don't speed at night until I get a V1.

Well, when going over 100 you don't have a choice. You HAVE to go to court.

Good luck with this. Any time you get cited for over 100, chances are slim that the court's going to cut you any slack. Also, be glad he didn't get the normal 100+ party pack ticket:

1) Excessive Speed
2) Reckless endangerment of life
3) Evading arrest

With #2 and #3 above, the citation becomes a misdemeanor, although under certain circumstances, #2 can be a felony. Personally, I'd pay the fines and humbly ask the judge to not throw the book at me. Asking for a reduction of the ticket, or trying to contest it, is probably going to cause more problems than it's worth. Just my 2 cents.

In Louisiana if you go 21 mph over the speed limit you have to go to court. For some reason the tickets here are also twice as expensive as other states. I guess it's to pay off all the corrupt cops and politicians.
