Need some legal info.....

so yesterday at work, someone pulled a dumb *** prank, and put super glue in my Pepsi. not funny. if i hadnt tasted the difference, i would have drank the whole bottle. mmm, nice and toxic..... my employer is doing an " investigation", but thats taking too long. if i call the cops, what kind of charge is the malicious idiot who did this looking at?

depends on how rough they want to be with the person. Could be considered an attempted poisoning if you have had previous problems with them...or they have a record of bad things. Most likely would be assault or reckless endangerment.

Yeah, that could upgrade it to aggravated assault or a harsher charge. You could even end up getting them fired by requesting a restraining order.

From personnal experience, go to your boss RIGHT NOW and demand that action is taken.
Use key words & phrases such as "harassment", "unsafe work environment", "my attorney suggests", and "I think I may have to escalate this matter to corporate" all will work wonders in getting this resolved now.

There's a difference between having a prank pulled on you & being poisoned.

According to my gf (a 3rd year law student), this is not assault, which requires they touch you with their hands or an implement.

Given that you weren't injured, theres nothing civilly you can do.

There IS a law in CA about poisoning though:

347. (a) (1) Every person who willfully mingles any poison or
harmful substance with any food, drink, medicine, or pharmaceutical
product or who willfully places any poison or harmful substance in
any spring, well, reservoir, or public water supply, where the person
knows or should have known that the same would be taken by any human
being to his or her injury, is guilty of a felony punishable by
imprisonment in the state prison for two, four, or five years.
(2) Any violation of paragraph (1) involving the use of a poison
or harmful substance that may cause death if ingested or that causes
the infliction of great bodily injury on any person shall be punished
by an additional term of three years.
(b) Any person who maliciously informs any other person that a
poison or other harmful substance has been or will be placed in any
food, drink, medicine, pharmaceutical product, or public water
supply, knowing that such report is false, is guilty of a crime
punishable by imprisonment in the state prison, or by imprisonment in
the county jail not to exceed one year.
(c) The court may impose the maximum fine for each item tampered
with in violation of subdivision (a).
If you can find this person, its a felony, though getting the DA to press charges when you haven't been injured may be difficult.

and as far as this, when i mentioned the words legal advisor, harassment, and authorities, they got all bent out of shape and prefer to keep it an internal issue. after talk to my legal advisor ( which i didnt know i had until now ) he says wait until tomorrow and bring in a labor attorney.
