joltdudeuc has brought this up a few times... On paper, it should be fine, though I'm yet to hear any first hand accounts of it being truly kosher.
It is weird though that an intake needs an EO number, but an intercooler apparently doesn't.
Edit: see page 7. Be glad we're not running diesels I suppose.

So a FMIC is NOT LEGAL unless it has EO #!
That's my first hand account because I was getting an AW11 MR2 BARed with a 3S-GTE!

Yes and No! An intercooler can be swapped out with a factory intercooler without EO # IF it still maintains the factory pipes and couplers! I heard it from the horse's mouth with my own ears! When the local state referee have questions, they talked to this guy and he makes the final judgement.

I guess one could, with some work, put a new Forester XT motor (w/100% factory FMIC) into a rex? I've never seen inside the engine bay of one, just theorizing.
Did your Gen 1.5 pass then? None of these schenanigans?

I haven't done another since but I found another loophole around the law. One can install a CARB legal intercooler and I bet it's easier to try to fit a greddy side mount because the stock SW20 doesn't fit. OR easier to modified a greddy IC pipe and not be obvious!
But I like CARB ... I've been to Mexico and my lungs prefer California air.

First off, if "carb" was about anything other than money, all they would care about is what comes out the end of the tailpipe. Not that you have "the correct smog stuff" not that you "did a swap" just what the motor is producing.
Second, do you really think its the cars that produce "smog"...really? Not perhaps oh, the factories that are all unregulated, the ships that all burn bunker fuel...

Rolling Coal...
...we will try not to dwell on diesels, whose only purpose for existence is to pollute the air as much as possible and **** on any good 20 Prii do by not polluting.
Google "Rolling Coal"
Definition of diesel.

I think it was a magazine article that I read last year where they talked about 1 single cargo ship putting out more "smog" in one trip than all the cars in the US put together for 1 whole year.
CARB
lol
Also as mentioned above - they are a joke. A joke that rakes in millions each year.
