Legality Issue with Selling Cars Question Please Drop Feedback
I have one very direct question to ask.
Is it illegal for a company such as Enterprise Rent a Car to sell a crashed vehicle either at auction or privately without reporting the collision in the case of over $700 body damage to DMV?
Basically I asked and a member supplied me with a CarFax which came back clean as a whistle. I looked at the car and it was clean. Then after I bought it had the car on a lift at the dealership to have them warranty a little thing they said come here, this car should be totalled. The frame was pulled, half *** rewelded, and everything you could imagine underneath where you couldnt see. Chrysler actually took tons of pictures and voided the warranty on the car. The jerk who sold it to me after he bought it from Enterprise when told of the situation immediately said he would give the money back and take the car back. Basically I'm prepping to talk to a lawyer about it all and want some feedback.
Cliff notes:
Enterprise auctions crashed car with WAY more than 700 in damage, never reports it to DMV, thus clean CarFax, guy buys, fixes, and resells with clean title like nothing ever happened.

I'm thinking maybe a class action. but if a lawyer thinks its a strong case by itself I will. Cause what they're doing is working with resellers to help them sell cars as clean when they're anything but.
subpoena all Enterprise sales over the last year from the location that sold the car i bought. Also subpoena any and all records showing drivers being charged for damages to their vehicles. Get DMV records subpoenas issued for all VINs related to accidents, that were sold without letting DMV know. Notify unknowing buyers of a class action....whatcha think?

Obviously I don't know the details but are you sure that the guy didn't do the shoddy repairs himself and hence the blame may be misdirected to Enterprise? In any case, I'd just worry about getting your money back by returning the car to the seller and move on. All the more reason to inspect the car BEFORE you buy it.

Get more claims of people having the same problem if you think it was Enterprise, if it just happend to you only, then it most like was the guy who sold you the car.

Yeah, like said in the first post, from what the damage looked like to the frame it should have been totaled a long time ago because the damage was so bad, so if that was the case, I'm pretty sure it would take a long time to fix it, but I'm pretty sure rental agency's have a time limit for how long you can have their car for.

While this is a good point, I'm out for blood now. These jerks collectively deceived me and endangered the lives of my family.
I without a doubt think the car should have been and still should be totalled. Refer to pictures above for an idea of the damage....this was the rear only in pictures. The front bumper, hood, fender, driver door was replaced, rear door, rear quarter, trunk lid, and rear bumper were all repainted.

To prove Enterprise did it, it will require getting a subpoena for all records involved with the car.
