lol I saw that yesterday and thought to myself.....that stupid kid doesn't know what he's doing and he for damn sure probably doesn't know a thing about politics to make a sound decision. He was probably acting on what someone told him to do.
The whole thing with "protection of property" and how that guy was in the wrong by setting up the electric fence really bothers me.
We have zero personal responsibility in this country today. People can sue you for anything. I'm sorry, but if you do some **** like that and get hurt: it's your fault.
I knew a lady growing up that had a swimming pool in her fenced back yard. The pool itself had a fence around it with a lock. The yard had no tresspassing and "stay out" signs. The pool had a "do not enter" and a "no lifeguard on duty" sign. The outer fence was 6' tall and solid wood. You couldn't even see the pool unless you stood on something to look over the fence. It was very obvious that nobody should have been in there. A few teenage kids jumped both fences and had a drinking party in the pool. One of the kids got drunk and when they were trying to leave he fell jumping back over the pool fence and broke his leg. The family sued the lady to pay for the medical bills and won....that kind of thing pisses me off.
You see the same thing with people protecting their property and even their personal safety.
I'm glad the kid got zapped and if it goes to any kind of trial I hope there's someone like me on the jury.

whats even funnier is about 2 weeks ago some people were going around my neighborhood putting Obama signs in peoples yards, including mine... They were making a bunch of noise so I come running out as they moved on from my house to my neighbors... I come running out full sprint and soccer kick the sign they left in my front yard so hard that it flies like 40 feet... Then pick it up and walk over to the people and toss it at them as hard as I can just barely missing one of the people... I then threatened to call the cops if they didnt get their commy asses out of there.
Neighbor saw the whole thing and started busting his *** up

Its too bad she didnt have an automated sentry gun and a back hoe... Bury those bastards in the back yard in 15 foot deep graves and call it a day. Bastards.

To invitees, you must make safe/warn of known and unknown (i.e. could find with reasonable inspection) dangers. To licensees, you must make safe/warn of known dangers. You do not owe trespassers any duty.
HOWEVER, in CA, a landowner owes the same duty to everyone, i.e. making safe/warning of known dangers, even to trespassers. There are also exceptions for child trespassers, i.e. if you know kids frequently trespass into your pool, you have a duty to make that pool safe and warn them, even though they have no permission to be in your pool in the first place.
I think any REASONABLE person would question why the hell anyone would owe anything to a trespasser, right? I do. You come onto my land without my permission, you do so at your own risk. But, of course, CA is a "progressive" (read: stupid) state, so what do you expect?
BTW, if you were on the jury for this case, the judge would instruct you to decide based on the law in CA, which is, the homeowner must have made his home safe to trespassers.....

Kinda reminds me of my college days when I was drunk and peed against an electric fence up on Hwy 9... Damm! I'll never forget that night...
