Since you have to go to court to beat this anyway, I would *want* the citing officer to show up (he probably won't). He may learn something that would prevent you and a lot of others from being cited again through ignorance.

From what most people tell me, if the cop shows and you pwn him, the judge will give the cop a tongue lashing since it's his (cop) job to know the law. =)

I was invoved in a similar case almont 10 yrs ago. A cop gave me a moving ticket for driving w/fog lights and the lights weren't yellow ( it was one of those PIAA 959s Ion Lights). I went to court and the judge dismissed my case in front of the cop right the way. He said it isn't illegal to drive with fog and if those weren't yellow, it should be a fix-it ticket instead. Bring it to court!
even though the chances of the cop coming to court is very small, make sure you have all the proof you need to beat this.
your owner's manual.
printout of the CVC mentioning color and height and when the lights are on.
photos of height, of lamps.
and make sure you checkk the ticket when the cop is off/vacation.
remember, cops get OT for going to court on days off and vacation so pick the date they are working...

Your first day in court is only to plead and make a date for a time when the "officer" is available. Then there is a chance he will NOT go to the second date because he was so wrong, but we have to get this notion corrected, that they are fogs and yellow is not needed. I also hope that equiptment violations are not "points" for your record, but I don't know for sure. I tried to ask my "cop" friend, but he was out partying
This is going a lil to far. When it gets down to the nitty gritty all you need to know is ANYTHING that originaly came equiped on a California car is LEGAL. Simple as that. You dont have to prove whether your lights are fogs or driving lights. All that you need to prove is your lights are stock. Oh and btw cops are paid extra to go to court. Depending on what force it is they either go to court during a shift where they get OT, or they get a flat fee. I have never actually heard a first person story where the officer didnt show up, but maybe some of you have.

Yes, bring a brocure from a dealership or some print out from edmunds.com or kbb.com showing that foglights come standard. Also bring a copy of that law, photos of the car, etc. to show to the Judge. Easy fight.
