I got a ticket in union city ( if you havent heard this read it)

Post I got a ticket in union city ( if you havent heard this read it)

ok ok , so i am on my way to uckk, following brucelee. we stop at a light, cop rolls onto alvaroado-niles. pulls off to right, lets brucelee pass, and pulls in behind him. rides his *** for like 3 min, then pulls over to right, i pass and he rolls on my *** for like 500 feet..

bang, lights come on.

pulls me over, and gets out of his car, asks me why i thought he pulled me over. i say " i have no idea"

so he says, well, you are driving with your " driving lights" and low beams on at the same time.

and i said, you mean my foglights?

and he said, no your driving lights " foglights are yellow"

so i said " and that is illegal? and he said yes.

asked me to get out and show him the lights, and how they switch on and off.

so he says its only legal to drive with you HIGH BEAMS AND DRIVING LIGHTS

so i tell him that the lights turn off when you engage the high beams.

so anyways he writes me a ticket for:

vc 24402A " driving wit driving lights on with low beams"

ok hella stupid, so i spent my new years eve finding the defanition of "driving and fog lights" we have FOG LIGHTS. so now i have to prove that my lights are "fog lights" to the court or i get 1 point on my driving record.

that sucks, just thought i would share

anybody had the same experience??

normally i side with cops whenever someone posts something like this, but this sounds way too much time on the dude's side.

unless your AUX lights are very bright and points slightly up to **** people off, you may have a case for your side.

also, if you have access to LEXIS-NEXIS, look for a case RICHARD RUSSELL v CALIF. his case is similar and he took all the way to win.

all you need is proof that your lights are fogs and they ONLY turn on when you have your LOW beams on and nothing else.

if they are indeed driving lights, check out HELLA's auxillary lights that are supposed to be street legal with low beams too, IIRC. see if yours are somewhat similar.

are your lights, the annoying type?

Oh thats you you space monkey!

What you do is you fight the ticket. All you need to do is to bring your owner's manual with you and show it to the judge. In it, the lights are called fog not driving. I assume it is legal to drive with foglights AND low beams on. If yes, then you win the case.

24402. (a) Any motor vehicle may be equipped with not to exceed two auxiliary driving lamps mounted on the front at a height of not less than 16 inches nor more than 42 inches. Driving lamps are lamps designed for supplementing the upper beam from headlamps and may not be lighted with the lower beam

here's their verbage about 'foglamps'

Foglamps

24403. Any motor vehicle may be equipped with not to exceed two foglamps which may be used with, but shall not be used in substitution of, headlamps. Fog lamps shall be mounted on the front at a height of not less than 12 inches nor more than 30 inches and so aimed that when the vehicle is not loaded none of the high-intensity portion of the light to the left of the center of the vehicle shall at a distance of 25 feet ahead project higher than a level of four inches below the level of the center of the lamp from which it comes.


it says nothing about it having to be yellow!

my lights are STOCK subaru impreza FOG lamps. By the definiton in the californa vehicle code, all of our lights are fog lights and perfectly legal to use with the low beams.

i took pix of thee car when i got home with a ruler, and the lights are above 12" and below 16" whick makes them fogs. i talked to a cop friend of mine and he said i may have to take the car to an " official headlight aiming station" and have them write a note that they are indeed fogs.

my cop friend also said the guy was an idiot.

I dont think you get a "point" on your record, (it's maybe more like a fixit ticket)but you will have to go to court so this will stop happening. Possibly you could post your case number(after you win) so we can refer to this "precedent setting" event. Good Luck

Maybe you can show them the owners manual that says they are fogs. Almost all cars that come with fogs now are white lamps. What determines a fog is pattern not colour:

thanks for all of the info guys, this guy was a pinhead, i again checked with my police officer friend and he said it does count as a point on a record and is a moving violation... how whack is that. anyways, i think i will take this to court on friday... then he wont have time to show up anyways.
