He's lucky those were some really nice police officers. At no time were they disrespectful to the driver...

There are other cops out there that would have used any excuse to screw him over as badly as possible, like the old drug sniffing dog trick.

BTW, those officers are trained in ID'ing drunk and intoxicated drivers... He spoke to them, they looked at him, saw his eyes, facial expressions, etc. They can tell when someone is high/drunk without the person answering that arbitrary question.

pretty much this. the officers could have been dicks and dragged this out but they made a quick judgement call that the guy wasn't intoxicated and let him go based off of that. it had little to do with his refusal to answer the question.

for checkpoints the law says you have to stop. that's it. anything else is voluntary unless they have reasonable suspicion. (you do have to surrender your license if they ask) but barring that, just refusing to answer their questions alone does not constitute reasonable suspicion. they could have been dicks, took his dl, and held him there for hours (notice how he asks if he's free to leave?) but they've probably encountered this before and didn't want to waste their time once they figured out what the guy was trying to do, and more importantly that he seemed very sober.

but I can't see that working all the time... he got lucky he met up with some officers in good moods.

I think you can usually tell when a cop is going to ream you with the long dick of the law as soon as he starts talking to you. Generally the first sentence is real short like, "...license and registration..." or "....step out of the vehicle." or my favorite, "I SAID HANDS MOTHER****ER..."

But legally...you can't be forced to incriminate yourself.
