How do I fight this tix???
KINDA LONG
SO this morning around 7am I had to drop my Mom off downtown. I turned onto Sansome St. for one block and than back onto Sanramento St. where I am at a red light making a left turn. While coming down Sac St I didn't notice any cars behind me and than I look up and SFPD is right behind me. I was like how did he get there so fast. My driver window is down, so I roll my pass window because its limo tint and I make the turn and he pulls me over.
officer: do you know why I pulled you over?
me: no officer
officer: you came down Sansome St where it clearly says "buses only"
me: Well, officer I was not aware of the sign and I am never down here
so he takes all my info and he is in his car for like 5 min and comes back out.
officer: Well i have to give you a tix because people turn/come down that street all the time and its for buses only
than he walks to the front of the car and looks and than walks to the back and looks around and than comes back to me
officer: So this is a Subaru eh?
me: yeah
officer: nice car, I haven't seen one like this.
me: thanks officer
officer: well have a nice day
me: thanks officer
well anyway he wrote me up for:
21461. (a) It shall be unlawful for any driver of a vehicle to fail
to obey any sign or signal erected or maintained to indicate and
carry out the provisions of this code or any local traffic ordinance
or resolution adopted pursuant to a local traffic ordinance, or to
fail to obey any device erected or maintained pursuant to Section
21352.
He didn't say anything about the front plates (they are euro plates) or my tint (well he didn't see the tint) so I guess I am lucky, but I still don't want this stupid tix. How would I fight this and what do I do? I never seen a street thats for Buses only in SF but than I rarely drive downtown. How much would this tix be anyway? Is it a point because its a moving violation?

Go back to the street where you turned and take a bunch of pics that show where you were etc and claim you didnt see the sign. My brother is fighting a rolling-stop ticket, claiming he didnt see the CHP officer...
yeah what he said, lots of pictures from all angles. also make a note right now exactly what you did and note things like time so you can accurately tell the judge. also note if there are any cars parked on the street. if there are, how did they get there?
you can win this tix, I know of people who fought running a stop sign because a branch was partially blocking the sign.

but I went back today and there are signs but the reason I didn't see them is because i stopped on the corner and my mom got out and I just made the right turn onto the street. The two signs that are there are actually pretty high so in order for me to see them I would of had to look up.
and it said buses only. WTH is that. I never seen a street thats for buses only. I saw traffic going the other way on the street and i saw the double yellow line so I turned onto the stupid street, which is for buses only. I NEVER SEEN A STREET THATS FOR BUSES ONLY IN SF.

NeVz I think you're going to have to eat this one. You can go to court and explain it to the judge but I don't think you're going to get much sympathy. Perhaps he'll reduce the fine a little but I think that's the most you can hope for. Your violation although not intentional is black and white. You were on the street. It's not like radar which can give a false reading or something that could be subjective on the officer's part.
