Got run into yesterday....

Got run into yesterday....

So I was leaving Starbucks yesterday (the one at Camden/Curtner next to 17) and right after I shift into first and start moving forward I get hit from behind by a VW Touareg. The guy jumps out and admits that it is his fault and he was completely not paying attention because he was more interested in making the light at Camden (by getting on Curtner in the "Keep Clear" area so he could skip the line of traffic). We exchange information and he keeps reinforcing that he is sorry that he ran into me. I have been screwed before by someone running into me, admitting it and then changing their story. That time the police came and then decided it was not necessary to do a report. Well, surprise, surprise, he filed a claim against me saying that I backed into him and he was completely not at fault. After doing my phone interview with my insurance it was clear to them that it was an invalid claim and it was denied. Now though I have to deal with his insurance, GEICO, and trying to get my car fixed. I have liability but my deductible is $500.

Here are some pics taken immediately after the accident and our cars are in the exact spot we impacted.

^ Interesting that my taillight is over there.....hmmm, almost like someone ran into it and knocked it off in that direction.

If you guys have any suggestions for me or if you have any left tail lights, either 02-03 or 04-05 let me know.

Lesson learned: ALWAYS GET A POLICE REPORT, EVEN IT SEEMS OBVIOUS WHO IS FAULT

Yeah police will try to not do the report if they don't have to. And unfortunately you have to assume everyone is out to screw you. Sorry. Good luck.

He is blaming it on GEICO, his insurance, saying that they told him to call my insurance and file a claim against me. Right now I'd be perfectly happy to run over both a caveman and a gecko...

That's bull. The douches that always act all nice after an accident that's their fault are usually the ones that turn around a file a claim on you ASAP. That's why you gotta file a claim with the opposing party's insurance first!

Insurance companies are usually pretty good about getting ish straight though, so even if it takes a while, you should hopefully be OK. Good luck!

So I pieced my taillight back together so I don't get pulled over for a fix-it while I wait for GEICO to get their act together. You can also see that I got real "lucky" that the damage is on the bumper and taillight and just missed the quarter panel by less than an inch.

This is your insurance companies job, not yours. Why the hell else do you pay them? Tell them THEY need to pay to get it fixed, pay your deductible and let THEM deal with GEICO. GEICO should reimburse your deductible as well since the claim is not through your insurance, its through his. Deductibles are for when you make a claim with your own insurance, not when its through someone elses...

I had an insurance company try to pull that bull$4i7 on me a few years ago when I got rear-ended.


...and now that I look at the pic above, I had almost the same damage on my WRX. ~$1200 IIRC.

You are absolutely right and I wasn't clear. Since they are my legal 'agent' and they are the ones that are representing me in a claim against GEICO, I referred to State Farm as me, but yes they are the ones doing the work.

...and now that I look at the pic above, I had almost the same damage on my WRX. ~$1200 IIRC.
The estimate that I got today, which I thought was high is for $865. That includes a replacement taillight ($167), paint/materials ($140) and 6.6hrs labor ($528).

...and I looked back at a couple pics of when I got nailed, I did have a bit of damage on the QP right where it meets the bumper as well.

So if anyone is wondering my car is back together again and GEICO covered everything.

I did a phone interview with GEICO and after a week and a half they finally got the guy to call them back and admit that he couldn't recall whether or not I was backing up, stopped, or moving forwards. This pretty much told them he had no effin' idea that there was a car there right in front of him hence it was his fault. The one thing that I wished I had done in hindsight is put my digital camera in movie-mode and acted like I was taking photos while I asked him (at the scene) if it was his fault and to confirm his name.
