I'm asking if you called the cops because they would know right away who is at fault... In this scenario you hit him, it's definitely his fault, cause he came out in front of you, but you hit him, and he can twist that easily. hopefully the police were there to file a report!

Just give the insurance company the details straight up and mention he ran the red light and DID NOT make it across the limit line. He was obviously not paying attention to the light while he crossed.

You know what the ****y things is about the cop is that he came in a squad car and said "You don't need to file a police report UNLESS you are transporting someone to a hospital." I think he was just being a ****ing dick and not wanting to make the report.
Since there was no report made, it all comes down to the statements you and the other party are going to have either written up or voice recorded and the damages on both sides. I personally would advise you to do a written statement that way you can think clearly on what happen and have all the details laid out. I would also advise you to go see a doctor or chiropractor if you have not done so already. Good Luck, bro.

INSIST and be very adamant about the situation and how it wasn't your fault. Don't let this guy get over on you... His statement will probably be short and he'll mention that his light was green or probably green, any uncertainty on his part will show that he's lying.

I didn't read this entire thread but I will tell you there is a chance you'll be screwed.
my story...
Guy runs red light. I t-bone him. We stop. He takes my insurance info. I turn around to grab something out of the car while he writes his. I turn around as they're driving away.
3 hours later cops show up.
They go find him by chance because he had to call a tow truck.
Write him a ticket for fleeing the scene of an accident.
Come back. Tell me that even though he ran the red light it's my fault because I entered an intersection while another car was in it. So it went 51% my fault. I lost my truck. They stuck it to my insurance company with $1000 in rental fees and damage that was there before the accident. Scratched rim... clearly curbed. Dented panel that I didn't hit... had the wrong color paint on it.
And I'm leaving out the good stuff. Lets just say johnny law didn't use any lube and was definitely sleeping.
