Excerpt taken from the United States Federal Penal code

Possession of stolen property punishable by a felony:

A person KNOWINGLY possesses stolen property when
that person is aware that he or she is in possession of property
and is aware that such property is stolen.1
[NOTE: If the property consists of three or more airline tickets or
two or more credit, debit or public benefit cards, or if the
defendant is a collateral loan broker or dealer in property, add the
appropriate presumption(s) from the "Additional Charges" section
of this Article.]
POSSESS means to have physical possession or otherwise
2See Penal Law §10.00(8). Where constructive possession is alleged, insert the
appropriate instruction as found in the “Additional Charges” section at the end of this article.
3See Penal Law § 155.00(1), for the full definition of "property." If the property in issue is
"computer data" or a "computer program," and those terms need to be defined for the jury,
see Penal Law § 156.00(2) and (3).
4See Penal Law § 155.05(1).
5See Penal Law § 15.05(1).
6See Penal Law § 165.55(1).
3
to exercise dominion and control over tangible property.2
PROPERTY means any money, personal property or thing
of value.3
STOLEN PROPERTY is property that has been wrongfully
taken, obtained, or withheld from an owner by a person who did
so with the intent to deprive another of such property or to
appropriate such property to himself or herself or a third person.4"
INTENT means conscious objective or purpose.5 Thus, a
person acts with intent to benefit himself or herself or a person
other than an owner of property
or to impede the recovery of
property by an owner
when that person's conscious objective or
purpose is to do so.
A person who knowingly possesses stolen
property is presumed to possess it with intent to benefit himself or
herself or a person other than an owner thereof or to impede its
recovery by an owner thereof.6
There's a difference between being a dishonest citizen, and knowingly committing a felony.

The property isn't stolen. Someone lost it and he found it. It's not like he stole some woman's bag in an elevator.

ok just read the bottom and nevermind what I said. lol

See, the OP's parents are really the ones to blame for this. Obviously his parents didn't feel the need to teach him things like honesty, respecting other peoples' property, doing the right thing when no one else is watching, integrity, and other concepts which most people replying in this thread get.

If the OP posts up some bad luck story, I'll simply know that karma (or "CAR"ma) got served up on him, and will sit back and laugh at his misfortune. Hopefully his RX-8 doesn't get into some sort of accident, or get stolen, or perhaps the lugnuts get loosened enough so his wheels fall off at high speed...

...that would probably be too much to hope for...but I'll hope for it anyway.

WOW i am totally amazed and just shocked by your words.

i did not steal the phone in the first place, and jesus christ you have to be so harsh and bring my parents in to this? are you serious??? WOW im just speechless about what type of person are you when you can simply just hope that i could crash or some crazy bad luck happen to be because i didn't return the phone to the AT&T store?????????!!!!!!!!!!!!!!

i did everything BUT just didn't turn it in to the store and i deserve this type of punishment??? i really think you guys are going way too far on this.

what i did is not against the LAW so F*** OFF. and what you are saying is getting very close from the line. because you know, if something happen to my car LIKE you described lug nuts fall off and cause a big accident. the police can simply target you as a suspect because of what you just said.

so watch what you say here man.

again. enough is enough. mods close this thread. are any of you mods even awake??? removing useless threads in to dumpster and not close this one?

threatening me with my car and wish me get in accidents? talking about my parents were not doing a good job teaching me? who gives you the right to say shi* like that? who are you? your parents made you so well that you talking shi* on here??? seriously, what you are doing is not being a good citizen neither, so what makes you better from me in your mind.

there are TONS of people who is like me, waited for the owner to call, but never heard from her, and tons of people would just keep it. but i can't believe there are people like YOU.

Everyone who is judging you should rightfully do so. You stole something that was not yours. Just because the owner was not near the phone doesn't justify you stealing it.

Hope karma bites you right in the ***.
please read the whole thread before you make a post please.

and i guess you don't understand the difference between found and stolen. if i steal something then okay bad karma comes to me. if i found something and i waited for the owner to call me and contact me, and not willing to go above and beyond take it to the AT&T store is now call stealing. call the police and have them arrest me. since in your words that i STOLE that iphone. go ahead and call the police.

get the story straight before posting. thanks

and mods still don't lock this thread after 2 requests from the OP and from another member? what do you guys do on here?

forum rules:
11. Flaming will not be tolerated for any reason. Users who verbally assault other posters on a regular basis will be set to Troll Mode. Name-calling is not acceptable. Moderator's judgment applies here. "You are wrong" is not a personal attack; "You are an idiot" is.

and what happen to the violators?

Members that violate these rules will typically be warned. If the offense is repeated then they may be banned for a time determined by the administrators and moderators. We don't want to ban anyone, so again we will use it as a LAST resort.

these are written VERY clear on the forum rules. so to all you people who were name calling and flaming should get an warning, and some members even chose not to stop after i personally asked to please stop the name calling. MBasile. rules are rules.

i kept the iphone i found, did not violate any LAW, nor any rules. is just to CERTAIN peoples mind that is not the right thing to do. but that certain group of people is clearly violating the forum rules. as VIP members, and senior i-clubbers i believe they should be very clear about those rules. correct???

I took that as more of an attempt to save face since in the original post it he seemed to think the thought of returning the phone was ludicrous.

I believe what you say, it's the ideology behind the words that is ****ed. I've made many valid points. Calling you out for being a dick is that same as saying that you are not a beneficial member of society, which I have also said. I don't *****foot around. If you are a dick, and present the situation that shows your dickness, I'll call you out for being a dick.

The message I got from your posts is that you are too lazy to do anything about returning the phone to AT&T. If you are going to say/do that, that is a dick move. Don't complain when people call you on being a dick.

Just as I'm shocked and awed by your refusal to simply drive to the nearest AT&T store and hand the phone into them. It's called integrity.

Well, from the things you are posting, you seem to refuse to take responsibility for doing the right (or by your choice, wrong) thing, so we have to look to how you were brought up. You were evidently brought up to believe that "finders/keepers, losers/weepers" is the right attitude to have. My parents, on the other hand, brought me up to believe that if I find something that doesn't belong to me, I'll take it to the police station, or call whatever number I find in the wallet, or turn it over to someone who has the ability to find the owner. In my case, my integrity and honesty would dictate that the phone makes it to the nearest AT&T store.

No, you did nothing of the sort. You came in here, let everyone know you're keeping this phone, and you wanted to know how to jailbreak it and make it yours...which from my point of view is keeping something that doesn't belong to you. You made no ACTIVE attempt to find the owner - you passively sit there and waited for the phone to ring - however, since the SIM was deactivated (as most people would do when they lose their phone), the owner COULDN'T call the phone. For you to say you don't know this is to say that you're rather stupid.

You're SO FUNNY!! Let's see here. In reading the above statement earlier on this page, it seems as though you ARE violating the law. What am I saying that's getting very close (from or to??) the line? Because I know if something like what I described happens, I'll have a few alibis of my choosing. Things like: I don't know who you are in real life, I don't know where you live, I don't know what color car you have, I have no motivation to conduct such actions...therefore no motive or opportunity will pretty much cross me right off the list of serious suspects. Watch what I say? I simply said I'd laugh at your misfortune brought on by your bad karma. I'd like to see the penal code section forbidding this? Please, show me where in the law books anywhere in the United States - laughing at anothers' misfortune is against the law. If it is, then you should be arrested for laughing at this persons' misfortune in losing the phone.

Is that because you're starting to feel the heat for doing something you know is fundamentally wrong? Yeah, I could see how you'd want to dispose of the evidence since you're guilty...

I'm not threatening you - even if I knew your address and knew which car you drove - I wouldn't waste my time. It would lead to bad karma for me to do something like that...
...as far as bringing your parents into it, I've answered that one above, so I won't go back there. Who am I? I'm a rather fundamentally honest person who was taught respect for others' property, honesty, integrity, and taught to go out of my way to return something that doesn't belong to me. You, on the other hand, were NOT taught that - and for that type of basic values education, I'd look to your parents to be the responsible ones to teach you that.

Again, if you're too stupid to realize that she couldn't call a phone that she deactivated (because it's lost), then you deserve whatever karma dishes up for you.

You ought to do the right thing and take the phone to the AT&T store. Everyone would quit hounding you, and you'd feel better about yourself - and who knows, something nice might come your way. Karma works both ways, you know.

I'm just hoping Karma finds a creative way of paying you back. Car crash would take something away that you love - perhaps like you've just upset the life of the true owner of this iPhone by disrupting hers.

my responsibility to go to ATT store? did you read the WHOLE 8 pages before you post???

her phone is locked, is not a wallet, so there are no name and address to be found. i can not go in to her phone to look up contacts. which means there is no way for me to contact her but to go to ATT store and waste my own time to find HER, when she is the ONE should been looking for me! so it was her responsibility to find me, not mine to find her. get that straight. if you lost a phone, you going to wait for the person who found the phone to find you?? or you going try to find that person??

i want to close it because people are violating the forum rules, and i feel offended by those name calling. is it clear now? btw you called me stupid on your last post =] which is against the forum rule, didn't you mom teach you not to call other people stupid? because my mom did, that is why i did not call any of you by names =]

AGAIN, if you have read my post.

i came here NOT to ask you people tell me where to return the phone, i ask how to unlock the phone. if i just ask and said how to unlock the code, then you people will think that i stole that phone. i wanted to make my self clear, so i gave a brief story about where i got this phone from. its just FYI, other than answering my question, you shouldn't be talking anything else but to address my question.
