I have an 03 wrx and about 3 months ago i blew my trans...It was cool though cuz it was still under factory warranty...I call the dealership and they told me to bring the car down so they could look at it. Two days later they call me and say that they arent goin to cover it under warranty... I said fine i will take it to another shop...But they say that i need to come get my car with $1200 cash for the labor that they did to Diagnosis the car... Now they are holdin my car until i bring the money... This is bullshat and is a crime...I need as much people to come down this weekend 14 15 16 to come support the wrx owners... You can come and watch participate, but the more people the better...

Isn't there some law in the state of California where you have to give an estimate of the repairs or something before you can start work on the car? Personally, Stevens Creek is an ***. I will never go there for anything.

there is a law that states that. if no estimate was given ( in writing! ), they cant charge you.

Look at the paperwork you signed. If there is no written estimate on there, they cannot charge you a cent. Any written estimate is your duty to pay though.

Honestly though, do you think picketing is going to help? If you didn't have a written estimate, they are holding your car for ransom, it's called extortion and it's illegal. Call the cops ASAP. I also bet you can find a lawyer that will look at your paperwork for less than 1200 bucks.

If I were in your shoes, and I was 100% sure I didn't agree to any estimates of 1200 dollars, I would be at the police station and wouldn't leave until they came to the dealership with me to get my car back.

So I fowarded this thread to the guy hoping your reponses would help and this was his response.

Thanks for the help.. I am 100% sure that there was no paperwork, and i didnt sign anything.. The first thing we did was call the cops and they said that what they are doing is legal...

hey! this sounds like me, brand new 2005 wrx back in 2004, and i put 30 miles or so on it when the tranny blew and my dealership said it was abuse haha. said i dropped the clutch, funny thing was there was 100 and something miles on it when i got it, and none of the papers were in the windows (the ones that say the mpg and options it has) and i ended up dropping about 2500 bucks... so lame. **** SOA. dont blame just the dealership... SOA(subaru of america) sends them a picture of an abused tranny and they say that the only possible way that happens is from abuse. so they have totally closed minds about it. but get a lawyer and about a year later you can win. take it to marin mazda when you get it out of there. they are the best.

Don't blame SOA, blame all the ***gots who claim that their trannies blow up for no reason when they were dragging it, doing 5k RPM clutch dumps, and thinking they can do burnouts in AWD. If people didn't thrash the car like that and try to get SOA to fix it under warranty, they wouldn't have to be so nitpicky and would work on legit claims.
