Unhappy CA Referee ?'s....

well as you have guessed...I need to visit the refereee!!

I got a ticket for intake....THATS ALL!! So, this means "back to stock"...right??

Does this mean I change EVERYTHING before I go to see them? Or do they have to see it and tell me to change it. I know it will have to be changed....just wondering if I do it before I go...first!

Also, Can they give me fines for the mods I have....if they see them?

back to stock you go. All stock... they are **** as hell. (They made me do it to my RS too). Why didn't you use the stock wrx intake? It works better than aftermarket intakes!

Dan, stock intake doesnt work with the FMIC....

Joe, (NO RACING INVOLVED)

I was driving my friend home....doing 40 in a 45....I came to a red light and saw a cop next to me in the turn lane ( i was going to go straight) When the lights turned green he stayed, and when I went he got be hinde me....so I told my friend that I was going to get pulled over. He followed for a good 1/2 mile or so and right when we were about to pull into my frieds complex area...I got pulled over....in the complex driveway.

He said "do you know why I pulled you over"? I said "uhh no"! He said "you dont know why"?? Again "no"!

"Uh...I pulled you over because... you have tinted windows past this pillar..........." . Then he asked if I had Modified exhaust, intake, ect...and he told me to pop the hood. So I did, and he said "yeah that intake is illegal".

So I got a fix it for the Tint, and a referee fix it for the intake....

Hey Guys....so I change this BEFORE I go to the referee...right??
and is there going to be fines involved?...or do they just sign it off?

It's actually no big deal for me to change all this stuff...good thing I have had practice...and it wont take long....but I need to make sure I didnt sell everything LOL.

I am actually thinking about changing it back to stock and then sell all my parts...I dunno

ps. He also wrote down my mileage so I cant really drive the car too much now...oh well....

There is a referee in Fremont. They are **** as hell. Hide your turbo timer.

The ticket is going to run you $250. It is not cheap. "Modified Exhaust" is not illegal. You should have rolled your windows down, and refused to pop your hood. Coulda Shoulda Woulda...I know.

I got mine in Santa Clara county. You will be getting the bill in the mail soon. Actually Freddie, you can pay it without "Proof of correction". That is what I did. uckf the mother uckfers. It is like $ 100 more, but you are going to pay $60 for the smog check anyway. Look at your bill from the court. It will say a price if "Proof of Correction" is submitted, and a price if it is not. I actually did the check and everything, but I never submitted and just paid the extra penalty. That is what I would do if I were you.

Damn...sorry to hear that Freddie. This is the reason why I hardly drive my WRX anymore. I usually roll in my civic. Hope everything works out bro...

Yeah, I did roll the windows down, Both sides, but he saw them I guess. oh well, not the first time. Plus I have a friend that will sign that off for me.

I didnt get a ticket for anything else. just window tint and inatke that's it. But I am fully catless so.......

I thought that if you refused anything they could take you in. So thats why I poped the hood. Plus for some stupid reason...I didn't care....

I will call you so you can explain...the fee stuff

funny thing was...I was just talking about selling all my stuff and going back to stock....cause I do race every once in a while. I was saying how I was getting tired of it too...then I pulled up next to the cop, and you know the rest. LOL

Yesterday was a bad day for me and my 2 other friends...so I am not shocked at all!!

to yesterday hahahaha

Heh, they were there before any of us had Imprezas. Freddie, I'd just pay the non-compliance fine and not worry about it.

Sorry to hear you got cited, Freddy.
Sucks to have to put everything back to stock.
Opening the hood or trunk or letting them crawl around in the cabin of the car is searching.
You never have to submit to searching without a warrant unless the officer has probable cause(saw the blood dripping out of your trunk, or your friend smoking up in the back seat).
Of course, you'll be on the pavement or in cuffs by they time the start digging in the car.
Cops aren't supposed to pull you over for infractions (tint, exhaust, etc) it is a waste of their time, often doesn't generate any revenue(versus cost of filing), and is usually a sign they are just pissy. They are supposed to catch you speeding at 20mph above, pull you over, you yell at them, they write you up for speeding and the little infractions to get back at you for giving them crap.
Some communities with problems have made statements that they will be ticketing anyone with a loud exhaust(or something similar) due to all the complaints, so then they will do it all around that area.

If you get pulled over for a non-traffic violation, you should ask them to confirm that.
"So I've been pulled over even though I didn't commit any moving violations??"
This may make a switch click in their brain that leaves you with a warning, but probably not.
If they ask you to pop the hood, trunk, etc, say something like "You are asking to search my vehicle? I wouldn't want you to waste any more of your time."
If they say "yes", or still want you to let them, you need to tell them "I do not concent to a search, officer."
Once you have done that, anything they find is not admissible in court.
I still wouldn't pop the hood or trunk myself, let them, they are the ones breaking the law. "You'll have to do that yourself officer, since I am not consenting, and you feel you have probable cause. Shall I get out of the car?"

It is hard to be firm about the law and not get them more pissed (especially if they are already pissed off), so you have to word what you say carefully.
This is why you try an add in key things, in the vein like, oh so humble little me wouldn't want you mr big cop to be wasting your time on me, non-criminal friendly guy.
If the cop if very insistant on being mean there isn't much you can do. You can attest to your rights, say that you feel threatened by their behavior even though they know you haven't consented to a search, that you feel like you are being harassed for no reason since they pulled you over even though you did nothing wrong, and you can ask for their full name, badge number, what precinct they are out of(city, county), and who they report to.
If you are very lucky, these things will make them nervous about their reasonings for pulling you over, since they have little substance for stopping you, or make them think you are a lawyer or legal freak they don't want to waste the time trying to get some little violation to stick on since you can represent yourself for free.

The sad truth is though, that they can pretty much do whatever they want under the guise of enforcing the law.

I was in a car with a friend who got pulled over, stopped, and undid his seatbelt to get his wallet out of his back pocket as the officer approached.
The officer asked how fast he was going, to which my friend replied "At a safe speed".
Cop says, "You were going a little fast there. License and proof of insurance, please." and takes out his ticket book.
My friend hands him his stuff and says "Did you radar me?"
Cop says "no".
Friend says, "Well I know you didn't pace me since you just turned in behind me on that street no more than a half a block back and that isn't enough time to use the pacing rule."
The officer, looks hard at him, and says "I was just letting you know you were going a bit fast. I'm writing you up for not wearing your seatbelt."
Friend says, "I took it off as you approached the car so I could get out my license for you. You had to have seen me."
Officer just looks at him.
I say, "I saw him remove his seatbealt after we stopped and take out his wallet from his back right pocket, your hono....officer."
The cops eyes get a little wider and he leans down and looks at me.
Then he says, "I'm giving you a warning for speeding, please drive safely in the future.", and hands my friends stuff back.
We stay put for a minute chatting about how lucky he is and the cop gets back to his car and peels out, racing passed us in a 25mph residential zone.
My friend was very happy with my intentional addressing slip-up.
