Intake...Milpitas Police. Officer H. Kwong...

Did not even realize that a BIG **** BLITZ FMIC AND PIPING are illegal. All that he cared about was the stupid intake...that is ridiculous...

Modified exhaust was on the ticket too...even though that is really not a broked law, but the cops use a technicallity for it...

I live in Stockton and know many local police officers and have talked to them about this "little problem" we are having.
First, the reason that most cops pull you over is that they are almost racial profiling only it's on a car manufacturer level as much as it is on a car owner level and it comes from wanting to stop street racing. The police figure that if they hand out lot's of tickets and pull over cars that fit a street racing profile, that they might just slow down an ever growing trend. Stockton police and CHP have been to "Import car training" learning what constitutes a real violation that will hold up in court. It would be crazy to think that a officer would know every detail about every import and domestic car on his streets. He can however look to see if a aftermarket intake is installed and then look for a CARB EO# and then write or not write a ticket. Perhaps then that person gets the ticket and has to pay a fine and get his/her car looked at by a state smog referee and will decide not to go to the local Friday night track and potentally get written up again and incure more fines. To some degree it is working. I have several customers that have stopped street racing and some have even sold their cars for less rice looking automobiles. Thought everyone might want to know why.

Ya, don't do that. If you are found to have an illegal intake and such, the cop can have your ride towed to the smog ref. It is his discression whether to let you take her home and get it smogged yourself, or to have it towed to the state smog inspector.

Bad choice to hassle the cop. If you have a sweet car, that is probable cause to look under the hood because it is common for cars with mods to have illegal smog equipment. Therefore, you have no choice in the matter.

The best thing you can do when a police officer pulls you over is to apologize for whatever he thinks you've done wrong and act like you're sorry you did it. Think about it from his point of view... do you want to hear some punk kid tell you about how you are wrong and that he is above the law or do you want to see that he understands he has done something wrong? Do you think you would be more likely to let him off with a warning if he understands he has done something wrong or if he thinks he is smarter than you and tries to make life different.

[EDIT:] Okay, the hard part here is trying not to be pissed off and ACT like you're sorry. I understand that YOU don't think you've done anything wrong but unfortunately HE does and that's all that matters. Unless you've got a CARB certificate in your hand you're not going to change his mind.

Just remember, he is the one authority in the situation because he can make your life a living hell whether you like it or not. If you act like a punk he is going to be far more likely to spend an extra hour or two (which he is getting paid for) to make sure you get screwed. If you are respectful and friendly, he'll probably either let you off or get you out of there without wasting too much time.

Hey, that's just the way I look at it and it has worked very well for me. I've been pulled over at least ten times and only got a ticket once. That one time happened to be when I was doing 95 in a 65 so I pretty much knew I was screwed from the get go on that one.

Amen...my buddy and I both got pulled over by the same CHP at the same time in college. We had been doing 80+ and the guy was well hidden in a tree grove on the side of the freeway. Neither one of us got a speeding ticket, but I was totally apologetic and respectful, while my jerkier friend got written up for tinted windows, out of state registration (which was LEGAL since his parents owned the car), and something else that I've forgotten.

When we got home from that, he was like "Man that cop shafted us...he was a jerk!!!"...and he couldn't BELIEVE that I didn't get a ticket.

oh well...just be nice even if it kills ur ego.

I talked a little more to one of my police officer friends and we came up with this approach. He says that if he pulled over a car and felt compelled to search it, and if the driver says no. That he can and probably will search the car. It's called "Probable Cause", all he has to to is show sufficient grounds for the search. Something like a new muffler, lowered suspension, biger brakes could all be considered "Probable Cause" for a search for more performance parts. Now, what he said might work (Although not with him now) would be to "Unhook" your hood release and come up with a new way to open it. If the cop asks to see under the hood, simply say OK but my darn hood latch broke last week and the dealer hasn't been able to fix it yet. He said that he would probably stop there as long as the person had a good attitude.
