Another Smog Ticket

After getting my 2nd smog ticket in 2 months I'll be selling some parts soon, so check the BA classifieds.

Pretty comical how I got this one though, I haven't driven the car in about 2 months so the battery was completely dead, I jumped it drove up 85 planning to cruise over to 280N. I missed the 280 exit, got off the next exit, and the darn car died. I asked the guy behind to give me a jump, just as I opened the hood the CHP shows up, he didn't even have to ask me to pop the hood, I already had the it open and waiting for him. I just got smog ticket this time, last time I got Modified exhaust too, cost me $650.

sorry to hear, what did he give you the ticket based on? Was your downpipe showing or...?
Wow modified exhaust is 650 now? i hear from some people its still a fix it ticket but from others i hear its a fine.

I've read so many conflicting reports of what the rules/risks are these days, I don't know what to think. Everything from being a fix it ticket to having the car impounded for 30 days. (which gets DAMN expensive)

Anyone have any ACTUAL knowledge of what happens if you get caught with less than stock cats? Or non CARB certified parts? Is it at the discretion of the cop or a judge?

First off, that sucks! Now to hopefull answer the question. It's really up to the police officer to decide your fate. He has the discretion to decide what to give you. The judge for the most part will agree with what the police officer says, but he does have the power to change it. If you have less cats or non carb parts, the police officer can do several things. 1. Give you a fix it ticket and send you to a smog referree 2. Can give you a ticket for a modified exhaust 3. Could impound your car 4. Could get you for a polluter (that could cost thousands of dollars) I think thats it. When I get the chance I will ask a few of my police officer friends.

This cop didn't know what the heck he was looking at on my car, he just saw blue Samco hoses when I was getting the jump start. He was pointing them out to a rookie officer he was with. He told her my Perrin Filter was fine, but the blue perrin intake pipe was illegal. And he said the blue Samco radiator hoses were illegal too. He didn't say anything about the FMIC. Also the license plate in the windshield doesn't count as being on the front of the car. (I have a C-West front bumper).

also did you try and defend yourself? like say anything to try and explain to him that its just a dressup item?

why are most cops such *******s, well its the CHP not city cops, city cops dont give a rats ***. any go to court on this one and put ur stock exhaust on before you do. the hoses in teh car are FINE they are perfectly legal to have in your car! Also ive heard of people with a cattless exhaust getting a 10,000 doller fine. on the mustang boards a guy got pulled over by a CHP for being too loud and the CHP made in go to one of the station thingys and they saw that he was catless and he got a 10k fine for modified exhaust and emmissions ****. Just dont go on the free way any more!! haha
