I knew it!! Mine was next!! I wish I had a digital camera, but the entire right back quarter panel is destroyed, brake light smashed out, because some doofus was doing like 40 down my narrow street as I was creeping out of my driveway. It's some old school electric blue 'BAVARIA' BMW. His hood is slighty crunched in the front, but he did my back end BAD. Now I'm late for work and my car is screwed!!! AHHHHHG!!!! I need to go vent.

Well if he was going more then the speed limit, then it may be his fault. As long as you don't admit to anything to him you'll be ok. Make his insurance pay for it. He should have stopped for you. It's not your fault for backing up out of your driveway.

maybe not applicable in the state of CA, but this is the Standard of Fault as defined by Massachussett's 211 CMR 74.00 in accordance with M.G.L. c. 175, § 113P:
(14) Collision While in the Process of Backing Up. The operator of a vehicle subject to the Safe Driver Insurance Plan shall be presumed to be more than 50% at fault when operating a vehicle which is in the process of backing up and whose vehicle is thereafter in a collision with another vehicle.
While negligence (of both parties) is an issue they'll consider, I believe most insurance policies have similar standards to determine fault.
