Hello to all
Heres the deal I have an 03 wrx with about 35000 miles on the odometer. Last month i staretd to get the first gear grinding when i tried to shift into first from a dead stop.
Friday i spoke to the dealer and i have done all my own stuff to the car (my father is a master merchanic) basically at this point just the tire rot. visual inspections of belts, change gear and trany fluid, oil changes..
Dealer told me subaru has a problem with this. b/c no one has done any work to the car (meaning them) that i have to show my records.. I have kept a log of all my work but i dont have receipts for all of the oil changes..
I have done nothing but keep care for my car as its my own money and dont want to ruin it.. They have a SOA rep coming in a week or so to look at my car to either deny/accept warranty cliam.
I have a feelin they are gonna try to give it to me up the dump.. I need any advice as to how prior owners have done. I cant se how they can deny warranty when the only thing that coudl have caused this is eithe ruseer abuse which it def isnt or not changing the trans/diff fluid which i have done...

If they decide to deny your claim, you may have a tough road ahead.
From the 2003 Warranty and Maintenance Booklet, pg 11:
I guess you could talk with the SOA rep and show him that you are a credible mechanic (or that your dad is if you want to say he did all the repairs) by providing certifications or other records of being an automotive expert. If they still deny the claim, have them do an inspection on the car (probably at your cost..maybe like a prebuy, which would probably run around $100) and have them report on the condition of the vehicle outside of the tranny (though I doubt that would be checked under a standard 27 point inspection).
Or if you really want to jack them up, contact legal counsel, tell that counselor your story and see if they'll come to your meeting with the SOA rep. That will show that you're not playing around and your laywer can probably give the SOA rep a few reasons why it would not be in their best interest to not deny your claim.

thanks for the advice...
as stated above i have done everythhing they have required of me except i havent changed the coolant yet (which isnt hard) and i havent chnaged the plugs, either of which woudl have no bearing on the transmission..
either way i rotate the tires and check pressure.. i mean 90% of my 35k miles are all highway as i have a long *** work commute.
if they deny my claim i will just make a call to the BBB.. and let them know they arent goign to use BS excuses to push em over
i have read to many times of how peoples claims get denied..if subaru is so behind their products then why do they make such a stink over fixing it?

The dealer cannot deny a transmission warranty claim unless you neglected maintenence on your trans. They cannot deny it if you havn't changed your coolant, rotated your tires, etc. because they have no relation to the transmission.

i have logged everything in the maintince book that omes with the car.. i cant belive the horible customer service... i mean if i had any mods other than dealer installed.. then i can see the need for coments car is one stock and they were grillin me on what i did to the car.. what part of stock dont u get?? well i have an appt for jan 12th or 13th when a subaru rep is gonna look at the car.. if they deny my warranty F them it's not that bad it aint gettin fixed if they aint payn for it..

well i took the car in yesterday and just got back.. basically they had no service issues b/c they car had been kept well, they said the usal $500 tear down looking for broken teeth (abuse) and i said no b/c i told them straight out i read about 100's of similar cases where subaru uses user abuse.. to worm out of it.. so he said call back in 2 weeks and make same claim make the rep come back b/c now he has a paper trial and he will try to get them to waive the 500 tear down fee.. so i will wait and see what happens.. at least they didnt totally try and screw me up the as*
they told me to put in syntheitc fluid b/c they tech there had same problem but with reverse.. so i will also try that
