Is Judge Sonia Sotomayor Qualified?

Is she qualified to be appointed to the Supreme Court?

Ricci v. DeStefano

U.S. Appeals Court Judge Sonia Sotomayor, mentioned as a possible Supreme Court nominee, voted to deny a racial discrimination claim in a 2008 decision.
She dismissed the case in a one-paragraph statement that, in the opinion of one dissenting judge, ignored the evidence and did not even address the constitutional issues raised by the case.
"All of the legal defense funds out there, they're looking for people with court of appeals experience the court of appeals is where policy is made."
As a district court judge, Sotomayor also allowed a racial discrimination claim to continue when the plaintiff, a black nurse, sued Bellevue Hospital Corp because other nurses spoke mainly in Filipino, their native tongue, which she claimed made her feel harassed and isolated.

If only we could elect people to appoint these judges and then have another branch of elected officials approve the appointee instead of us having to speculate on whatever the news media supplies.

Sotomayor reversed 60% by high court

With Judge Sonia Sotomayor already facing questions over her 60 percent reversal rate, the Supreme Court could dump another problem into her lap next month if, as many legal analysts predict, the court overturns one of her rulings upholding a race-based employment decision.

Three of the five majority opinions written by Judge Sotomayor for the 2nd Circuit Court of Appeals and reviewed by the Supreme Court were reversed, providing a potent line of attack raised by opponents Tuesday after President Obama announced he will nominate the 54-year-old Hispanic woman to the high court.

"Her high reversal rate alone should be enough for us to pause and take a good look at her record. Frankly, it is the Senates duty to do so," said Wendy Wright, president of Concerned Women for America.

All appellate courts have a high reversal rate because the Supreme Court Justices almost always take cases that they want to overturn, and to my knowledge all appellate courts have an overturn rate of 60%. Sotomayor has presided over 380 cases, only 6 of which were reviewed by the Supreme Court, and only 3 of those were overturned. That's actually an overturn rate of less than 1% of her total caseload, and 50% of the 6 cases brought before the Supreme Court.
