First of all, Vienna (and this trial) are in Austria not Germany (but they do share the law against saying the holocaust was fake).
Second of all, Germany was never socialist; East Germany was once (but it was considered a part of the USSR/Soviet Bloc), and before that the whole country was a dictatorship, but West Germany has never been anything but an American style democracy...and 'modern Germany' is pretty much West Germany getting reign over the whole country.
Aside from that, I agree that this law seems a little at-odds with freedom of speech. I've never looked at Germany or Austria's constitution/bill of rights equivalent though and I'm not sure they are guaranteed that right.
Of course...in this case I don't care, because the guy that got jail time is a total f***wad.

Germany and Austria are two very diffrent places. They may be close, and both were allies in W.W.II., but there is a very diffrent culture between the two.
Secondly, Germany leans much more "right" currentlly than many other European countries. Yes, they may have many more laws insuring education and health care of it's citizens but so does almost all of Europe right now.
