tranny out

my second gear went. so i dropped my car off at the dealership to have it looked at. they dropped the tranny and didnt even open it up. they said bits of metal came out when they drained it and they showed the SOA guy. they didnt even open up the tranny and denied my warrenty. he said hes seen metal shaving b4 on other cars and new it was from abuse. can they do that? or do they have to completely open it up and look at everything and 2 say something?

How much metal shaving was on there? It's normal to see some metal shavings on the end of a drainplug. Hell, that's why it's magnetic to keep the tiny metal shavings from getting into places and causing more damage.

If there was a ton covering the plug then it can say that
A) You can't drive a stick
B) You drive the crap out of your car

In either case I would have been interested in the amount of metal shaving on the plug.

Somebody here might have a link to the internal transmission service bulletin that SOA sends out to their techs to help determine if somebody has been "abusing" their car. The bulletin usually outlines what signs to look for; maybe SOA says metal shavings are all they need. I don't know if there is any law that says they have to go further, but I think they should.

Now that I think about it if the second gear was already borked then a lot of metal shavings should be expected, but what do I know I’m just an internet moron.

Here is some sick **** I stumbled upon:
Subaru of America was awarded 75 large late last week under California’s Consumer Legal Remedies Act. A ballsy WRX owner tried to defraud Subaru in bringing the action against them, claiming that an alleged defective transmission in a 2002 Impreza WRX should be repaired or replaced under warranty. It’s not hard to speculate, at all: the owner most likely abused the car and busted his transmission, and was then trying to get Subaru to cover the cost of repairs. The $75,000 is meant to cover legal fees expended by Subaru in defending the case

I hear the RA gears help, but the forks and split of the transmission also make it "weak", but good luck with the RA gearset.

I was looking at Rallipsecs site and the sell the STi Standard Ratio Gearset and the STi RA Close Ratio Gearsets. The STi Standard Ratio Gearset states that it comes with "Gearset includes all necessary parts for installation. This is now available with a revised dual cone uprated 1st synchro & hub set." Not to sure what that means, but ithe STi RA Close Ratio Gearsets makes no mention of that.
