hey guys,
I posted a few days ago about the trannsmission problems that I am having with my 02 wrx. Basically, I was driving last Thursday and as I shifted to second, my tranny blew out. I get it towed to the dealer and they denied my warranty cuz they claim this as an abuse on my part. I couldn't beleive it, and it still pisses me off when I think about it.
Basically, I want to do as much as I can to see this get resolved the right way. I am planning on talking the the Subaru Rep. and getting thier statement in writing.
This is where I need your guys' help. I know that there are a lot of people with tranny problems on thier wrx's. I have talked to some of you through email. I want to make a log of the instances where people have been having tranny problems.
If you experienced a problem with your tranny(excluding the clutch annoyances) please post them here. Please provide

I am aware of this website but I wanted to target those who have been having tranny problems only. Especially in the cases where the teeth were stripped or chipped from thier gears.

there is a service bulletin posted to all dealerships on Nov. 18th. to deny warranty work on any transmission with missing teeth, and bent shift forks. Do they have the right to do this? Yes. Can you fight them? Yes. If you didnt abuse your car, you have every right as a citizen of the U.S. to use your local court system to fight for your consumer rights. I did and I won. (as iBlueVirus noted)
Subaru is doing what any company would do in their shoes. (covering their ***) They have an old outdated tranny in their automobiles and havent spent the money to introduce a new one to the U.S. In some cases, people have abused their rex and broken the trans, but other people (including myself) were unlucky enough to have it happen unwillingly. The judge will look at both sides of the argument. If you have a valid argument, then you will win. Subaru has nothing in their defense besides the fact that they "think" you abused your car so they are being cautious. They will try to blame it on inexperienced manual driving, AWD is new and different to drive, "our consumer base for the WRX is a younger, less experienced driver", etc. Basically they have no way to prove one way or another how your transmission broke. So fight it and you should win.
also try contacting these consumer protection attorneys (very nice people) Terry Baker was the man I came into contact with (breifly) He had a pending lawsuit against subaru for the same problem.

You might wanna try sighting some different case that people had against Subaru with their trannys and they won. Go in there with full confidence and just let them know that if they really want to take be that way and have this problem taken to court, you'll do it. And then show them the cases where Subaru lost. Maybe that'll change thier mind. I'm no lawyer though. I'm just thinkin' maybe that would be enough and you wouldn't have to waste your time in court, ya know?
