my poor car!!!
a lil update... i took the car to fountain valley bodyworks. i heard they are pretty good and hopefully i could get this squared away soon. i finally got my police report and it says i was at fault
this is the first time i've ever been involved in a accident so i dont know what is gonna happen since im at "fault"

i was traveling north bound heading to work. had to turn left to get to work. south bound traffic was very heavy. it was backed up about half a mile from their stop light. there is 2 lanes going south, 2 going north and the middle lane with yellow lines to turn left. so i got into the middle lane and traffic was blocking the driveway to work. so the drivers crept forward to give me enough room to turn left. at the time the light was red so south bound traffic had stopped. so i turn left and the lady in her truck was passing traffic on the right lane shoulder (southbound) and nailed me. she wanted to turn right at the intersection. but from where she hit me, its a little bit over a quarter of a mile to the intersection. she never hit her brakes. there is only 2 lanes, not 3! i would understand if she wanted to turn into the same driveway as i did, then yes its my fault. but she didn't, she was going to pass 3 more driveways on her way to the intersection.

i've only been working there for a few months and after the accident i was told that there has been at least 8 accidents like that in the past 5 years. but the city hasnt bothered to paint "keep clear" message on the street or put a stop light there.

did there happen to be a bike lane or a solid white line between the right lane and the curb that the truck was driving in? that would help your case.

i'd agree.. i fight for it. because it's not a clearly painted line indicating that's it's an lane.
That truck would be driving off the shoulder and should be consider illegal.
If she wanted to turn right.. she should be waiting in the lane with the traffic.

A couple of years ago I was in a similar accident and the police report said I was at fault.
In my statement I said my light turned green, I checked the street and it was clear. A second later an XB decided to explode on my driver side front.
What the driver of the XB said was the light just turned yellow and she went in and plowed into to me.
So the conflicting statements and the view of the damage. The police deemed it as me running a red light from a stop hitting on coming traffic.
I fought it and won. I got security footage from the surrounding buildings from 2 different views. It showed I waited for the light to turn green and go since the street was clear. It also showed the XB flying down running a red and nailing me.

When you pass a car you cannot pass on the right side in a single lane(2 lane, 1 lane per direction) (the lanuage maybe different but this is what I remember). eg. If the car in front of me is trying to make a left in a single lane, I usually wait behind this car instead of going around him on the right side because that's not legal.
Back to your situation. This person that hit you was driving on the right side passing cars (which is illegal: two cars in one lane, and this person is passing car on the right side). If you can get this person to say that there was traffic and this person is 'passing' all these cars on the right side of a single lane to make a right... this person can be in some sort of trouble too. You maybe at fault still, but at least you make her pay a fine for her stupid mistake.
