It's very illegal, but undetectable unless you're looking for it and have the Subaru dealer diagnostic tools. OBD-II scanners don't pick it up on pre-'05 models.

The smog checkers should be able to read the check sum/VIN code on '05+ stock ECUs. EcuTek says they will not provide a way to defeat this as it's illegal to do so.
