It's very illegal, but undetectable unless you're looking for it and have the Subaru dealer diagnostic tools. OBD-II scanners don't pick it up on pre-'05 models.

The smog checkers should be able to read the check sum/VIN code on '05+ stock ECUs. EcuTek says they will not provide a way to defeat this as it's illegal to do so.

easier said than done the guy who did my smog was some asian kid w/ a really nice 240. after the smog i was talking to the guy, he knew that i had modification i.e like a FMIC ect.... but he just let me go :D
