does the latch prevent it from being opened or not hold it down?

The latch stops it from being held down. Its a common problem, a lot of these loose the top latch at one point or another. Bottom one latches fine. Still a great deal though because you can store a ton of more items. I just put the stuff I use more on the top and all the less important stuff on the bottom.
