Question what should i do about this ticket?

gday all. i got a speeding ticket at the end of august, and they still havent sent me the ticket in the mail. its been a good 3 weeks, and i just called them and after waiting for a good half an hour on hold i get a lady telling me that there is no citation on file, and to call back in 2 -3 weeks, click, hangs up. but if i wait for another 2 - 3 weeks that court date on the citation, is up.
what to do? thanks.

go to the court house and check on it.... if there is still no citation on file, be happy you got off and try to get some type of note stating that you went to the court house to check on the status of this citation......

Most likely you're off the hook. I would just call the courthouse again and tell her that if you wait, the deadline is up.

good deal. going to call them again soon just to make sure.
theres no way the court can pin this on me right? i called them and will call them again making sure why there was no ticket in the mail, and they told me there isnt one in file. not fancying the thought of being someone's bride.

Scooby got caught riding a little fast huh. It could be that the cop didn't turn in his part of the paperwork yet, so stay put. That's what happened to me awhile back when I got a ticket. I called using the automated system and they couldn't find my citation. Just my luck that it turned up two days after that. Just wait a week and call back to see what they say, if it's still not on file, then ask her about your court date. I mean after all, it's not your fault that the cop didn't turn in his part, plus why would you go to court if there's nothing on file? Cross your fingers and hope that you get out of this one.

Eh you know how cops are, they pick the easiest one they can get unless there is someone who's really being a-hole. I've looked at ticketasassin before and they suggest you fight it by mail. I don't know if you should do that unless you get some real info on those who have used that method, and whether or not it works. You should always fight a ticket though, either you can decrease the amount you have to pay or you get traffic school, what do you have to lose? Even if you were to pay the full price of the ticket, no biggie at least you gave it a shot, who knows you might even get it dismissed. Well if you do decide to go to traffic court, just state that you were going the flow of traffic, and that what it says in the driver manual. I'm sure me and the guys can help you think of something to tell the judge. FIGHT THE MAN!!!! to cops.

1. You have the right to remain silent. Anything you say can, and will, be used against you in a court of law;

2. You have the right to consult with an attorney and/or to have one present when questioned by the police; and

3. If you cannot afford an attorney, one will be appointed to represent you.

now that you know your rights, do you wish to talk now?

look, there is such thing as DUE PROCESS and while your ticket may have fallen through the cracks of justice, you dont wanna be surpised next time you are pulled over and find that there is a warrant out for you.

take care of it now before it does escalate and you do end up being bubba's girlfriend... (worse case of course...)

alright leo, if i call them again within these 3 weeks, and they tell me the same thing, they dont have my citation on file, what do i do? do i tell them i got a ticket and want it mailed to me right now, or do i just believe i got lucky and drive slower?
ill be seeing you around for lunch this year. i got a two hour break.

well barry, im not exactly the most confrontational person. ill just pay the fine and do traffic school. i dont see how i can fight it. i was going above the speed limit. no way around it. it was my bad. just sucks because i was going with the flow of traffic.

The Miranda rights apply when someone is being interrogated by the cops, so that they do not incriminate themselves and have a chance to speak to counsel. Those rights do not help in a speeding ticket. Anyways, since he brought up lawyers, you can get one that specializes in traffic violatoins, they're usually not that expensive and they can usually get the ticket reduced or even dismissed.
