It appears there is not much I can do other than taking this to Small Claims and wasting my own time in hopes to retrieve $150.

What a f***ing scam!

I guess by LAW these private lots do not need to post anything other than a stupid sign stating there is a tow company, towing is at owners cost, and so forth. There is a code: http://www.dmv.ca.gov/pubs/vctop/d11/vc22658.htm

the only thing that it will be hard to prove cause i think he didnt get a reciept for the drop fee

yeah i know the feeling. i almost lost it on the first douche who pulled this on me. he got away with my $75...but i figured after researching it and knowing what i probably could and could not do, i was able to keep my cool the second time.

regardless, it's a crappy experience overall. one of the many reasons why i am happy not living in the city anymore!

Well, even if you decided not to think straight and sort this guy out properly (which he would unquestionably deserve), I am sure you would not have hard time finding "alibi" placing you somewhere away from the scene of the "accident"

as for not being allowed to park there.

If BevMo does not want a car parked in their lot, they have to report it. Given BevMo was not open, there wouldn't be anyone there to call to have the car towed.

Indeed - The driver needs a sign off from a BevMo rep to do what he did.

Next time call the cops and report that its being stolen.

Find one of the company trucks and take out $150 on its paint work. Problem solved. Maybe some sort of message to alert the public to the company's ethics would suffice?
